In the Estate of Eliza Donnelly deceased, I Margaret Donnelly of Carbonear in the Electoral District of Carbonear, make oath and say that I believe the paper writing hereto annexed and marked by me to contain the true and original last Will and Testament of Elizabeth Donnelly late of Carbonear, in the Electoral District of Carbonear deceased; That I am the executrix therein named and that I will well and faithfully administer the estate and effects of the testatrix by paying her just debts and the legacies contained in her Will so far as the same shall thereto extend and the law shall bind me, and by distributing the residue (if any) of the estate according to law, and that I will exhibit under oath a true, full and perfect inventory of all and singular the estate and effects, rights and credits, of the testatrix, and render a just and true account thereof whenever required by law so to do; that the testatrix died at Carbonear on the 26th day of April one thousand nine hundred and that the gross value of the estate and effects, rights and credits of the said testatrix is fifteen hundred dollars, and no more, according to the best of my knowledge, information and belief.

Three days from the date hereof application will be made to the Honorable the Supreme Court or one of the Honorable the Judges thereof for a grant of letters of Probate of the Will of Elizabeth Donnelly late of Carbonear deceased to Margaret Donnelly the Executrix named in the Will.

The petition of Margaret Donnelly of Carbonear, spinster

Humbly Sheweth

  1. That Eliza Donnelly of Carbonear married woman died there on or about the 26th day of April last past having first duly made and executed her last will and testament, which is here to annexed marked "A"
  2. That the said testator is and by the said will appointed your petitioner the executrix thereof.
  3. That said testator left her surviving a husband and three children of whom your petitioner is the eldest.
  4. That at the time of her decease the said testator was possessed of property within the jurisdiction of this Honorable Court to the probate value of $1500.00.
  5. That no probate to the will or administration of the estate of the said testator has heretofore been granted to anyone.

          Your Petitioner therefore prays that Letters of Probate to the Will of the said testator may be issued forth of the Honorable Court to her as such executrix and as in duty bound she will ever pray etc. etc.
          Dated at St. Johns this 18th day of July 1900

NEWFOUNDLAND
Carbonear   To Wit          I  Edward S. George of Carbonear make oath and say that on the thirteenth day of April A.D. One Thousand Nine Hundred I was present and did see Eliza Donnelly late of Carbonear married woman the Testatrix named in the paper writing hereunto annexed, marked A, duly sign, publish and declare the said annexed paper writing as and for her last Will and Testament, in my presence and in the presence of Patrick Hogan the other subscribing witness thereto. That I and said Patrick Hogan then and there signed our names to such Will as such witnesses, in the presence of the said Testatrix and of each other, and that at the time of the said execution of the said Will the said Testatrix was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.

A

          This is the last Will and Testament of me Eliza Donnelly of Carbonear, married woman. I give, devise, and bequeath all my Estate, consisting of a dwelling house and land, situated on the North side of the Main Street of Carbonear, a store and water side land and premises situate on South side of said Main Street of Carbonear aforesaid, a piece of land situate on Patrick Street, two pieces of land situate on Chapel Hill, all my household furniture and all other property and personal effects whatsoever and wheresoever , to and unto the sole use and benefit of my children Margaret Donnelly, James William Donnelly, and Maddelen[sic] Donnelly, their heirs, Executors and Administrators and Assigns according to the nature and tenor? thereof.
And I appoint my said Daughter Margaret Donnelly executrix of this my last Will and Testament.
In Witness whereof I have hereunto set my hand the thirteenth day of April in the year of our Lord one thousand nine hundred.
