NEWFOUNDLAND
Channel   To Wit          I Solomon Gilliam of Channel aforesaid Schooner owner do swear that I believe this to be the true Last Will and Testament of Thomas Dicks late of Channel, aforesaid, Schooner Owner deceased. I do further swear that I will pay all the Debts and Legacies of the said deceased so far as his Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Thomas Dicks deceased, and of which he died possessed, do not, according to the best of my knowledge, judgment and belief, amount to the value of Four thousand five hundred dollars

Jersey
to wit: I John E. Horman? formerly of Channel in the Colony of Newfoundland, Merchant, but at present residing at St. Boclades? Jersey, make oath and say:

  1. That by the will of Thomas Dicks late of Channel aforesaid, Schooner Owner, deceased, I have been appointed an executor thereof
  2. That I have not in any way acted in the office or capacity of Executor of said Will, nor have I done any act or thing in relation to the Estate of said testator or interfered or intermeddled in the affairs or business of the said Estate.
  3. That I have left the Colony of Newfoundland and am at present domiciled in Jersey
  4. That I desire to hereby renounce and disclaim? the office of Executor of the Will of the said Thomas Dicks.

Notice

After three days from the date hereof, application will be made to the Honorable the Supreme Court, or one of the Honorable the Judges thereof, for Probate of the Will of Thomas Dicks, late of Channel, Newfoundland, Schooner-owner, deceased, to be granted to Solomon Gilliam, of Channel aforesaid, Schooner-owner, one of the Executors named in the said Will.

In the name of the Lord Amen

I Thomas Dicks of Channel in the Southern District of the Island of Newfoundland Schooner Owner, being of sound and disposing mind and memory, calling to mind the frailty and uncertainty of human life and being desirous of settling my worldly affairs, and directing how the estate with which it has pleased God to bless me shall be disposed of after my decease, while I have strength and capacity so to do, do make and publish this my last will and testament, hereby revoking and making null and void all other last wills and testaments by me heretofore made, and first I commend my immortal being to him who gave it and my body to the earth to be buried with little expense or ostentation by my executors hereinafter named.
And as to my worldly estate and all the property real, personal or mixed of which I shall die seised [sic] and possessed or to which I shall be entitled at the time of my decease, I devise bequeath and dispose thereof in the manner following: to wit:
My will is that all my just debts and funeral charges shall by my Executors hereinafter named be paid out of my estate as soon after my decease as shall by them be found convenient
I give devise and bequeath to my eldest son George Edward Dicks one-half

One-half of my schooner, The Maggie A, with the privilege of either buying out the remaining half from my Executors for the sum of eight-hundred dollars or of working out the half-share above mentioned the said schooner The Maggie A.
I give devise and bequeath to my wife Sarah Dicks the use of my dwelling houses with their appurtenances, situate in Channel aforesaid, and the interest and income that may annually accrue from all monies or property, real, personal or mixed of which I shall died seised [sic] and possessed, or to which I shall be entitled at the time of my decease, to be devoted by her to the support of herself and of my children Mahala, Patience, Susanna A., Solomon, Harriet S., and Thomas Dicks during her lifetime or widowhood. But should my said wife marry again, then all my estate, real, personal or mixed shall be divided by my executors between my six last-named children, share and share alike.
And I also direct that all monies belonging to my said estate are to remain invested as they are at present and that the principal of the same shall not be drawn for the purpose of being placed or invested elsewhere.
Lastly, I do nominate and appoint Solomon Gillam of Channel aforesaid schooner-owner and John E. Horman also of Channel aforesaid merchant

to be executors of this my last will and testament.
In witness whereof, I hereunto set my hand this twenty-third day of March in the year of our Lord one thousand eight hundred and ninety-three.

Last Will and Testament

To the Honourable the Supreme Court of Newfoundland, or one of their Lordships, the Judges thereof.

The Petition of Solomon Gillam of Channel in the Southern District of the Island of Newfoundland-Schooner owner

Humbly Sheweth

  1. That Thomas Dicks of Channel aforesaid-Schooner owner, died at that place on the 24th day of October A.D. 1898, and that at the time of his death the said deceased was possessed of property and estate within the Jurisdiction of your Honourable Court, of the probable value of Four thousand two hundred dollars
  2. That on the 23rd day of March A.D. 1893 the said Thomas Dicks made and executed his last Will and Testament, of which he appointed your Petitioner and John E. Horman, also of Channel aforesaid, Merchant, to be executors.
  3. That the said John E. Horman

    has since left this Colony and resides in Jersey.
  4. That the said Testator left him surviving his widow Sarah Dicks and as next-of-kin seven children namely - George, Solomon, Thomas, and Harriet Dicks, also Patience Seeley, Mahalla Squarey, and Susanna Seeley.
  5. That no application for Probate of the said Will or for administration to the Estate of the said Testator has heretofore been made to your Honourable Court.

          Your Petitioner therefore humbly prays that your Honourable Court or one of your Lordships, the Judges thereof, will be pleased to grant unto him Probate of the Will of the said Thomas Dicks deceased.
          And as in duty bound your Petitioners will ever pray etc etc

          I N. Smith of Channel - Postmaster ??? make oath and say that on the 23rd day of March A.D. One Thousand Eight Hundred and Ninety three at Channel, I was present and did see Thomas Dicks late of Channel aforesaid, the Testator named in the paper writing hereunto annexed, (marked A and identified by my initials), duly sign, publish and declare the said annexed paper writing as and for his last Will and Testament, in the presence of me, and of R. J. Squarey, Magistrate, the other subscribing witness thereto. That I and said R. J. Squarey then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other, and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.
