In the Supreme Court of Newfoundland

NEWFOUNDLAND
Harbor Grace To Wit          } We John D. Martin of Harbor Grace aforesaid Boot and Shoe manufacturer and John Tapp of the same place do swear that we believe this to be the true Last Will and Testament of Hector Curtis late of Harbor Grace aforesaid Master Mariner deceased and we do further swear that we will pay all the Debts and Legacies of the said deceased so far as his Goods shall extend, and the law shall bind us, and that we will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when we shall be lawfully called thereto. And we do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Hector Curtis deceased, and of which he died possessed, do not, according to the best of our knowledge, judgment and belief, amount to the value of Three thousand dollars

Three days from this date hereof application will be made to the Honourable the Supreme Court or to one of the Honourable the Judges thereof for Letters of Probate of this last Will and Testament of Hector Curtis late of Harbor Grace Master Mariner deceased to be granted to John Tapp of the same place Blacksmith the Executors in said Will named :-
          St. Johns, January 30th AD 1900

In the name of God amen

          That I Hector Curtis Master Mariner of Harbor Grace in the Island of Newfoundland, being in good bodily health and of sound and of a disposing mind and memory calling to mind the frailty and uncertainty of human life and being desirous of settling my worldly affairs and directing how the estate with which it has pleased God to endow me with, shall be disposed of after my decease, while I have strength and capacity so to do, make and publish this my last will and testament, hereby revoking and making null and void all other wills if any and to my worldly estate and property, real and personal, I devise bequeath and dispose in the following manner, to wit:
          I give devise and bequeath to my beloved wife, Matilda Curtis, all my land and dwelling house and furniture situated on East side of Wood Street in Harbor Grace in said Island of Newfoundland and all my money if any at my death and land bounded on the East by the late Robert Andrews land, North by my brother James H. Curtis' land, measuring

North and South of Wood Street

Martin of St. Johns and my friend John Tapp of Harbor Grace to be executors of my will and testament in testimony where of I said Hector Curtis have to this my will and (rest of line illegible)
two or one sheet of paper to every sheet thereof subscribed my name and affixed my seal this day in the year of our Lord one thousand eight hundred and ninty [sic] seven.

Harbor Grace To Wit          }
I John D. Martin of Harbor Grace Boot and Shoe Manufacturer make oath and say that on the first day of December A.D. One Thousand Eight Hundred and ninety seven I was present and did see Hector Curtis late of Harbor Grace, Master Mariner the Testator named in the paper writing hereunto annexed marked A, duly sign publish and declare the said annexed paper writing as and for his last Will and Testament, in my presence and in the presence of John Tapp of Harbor Grace aforesaid Blacksmith the other subscribing witness thereto. That I and said John Tapp then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other. And at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.

TO  THE  HONOURABLE  THE  SUPREME  COURT  OR  TO  ONE  OF  THE  HONOURABLE  THE  JUDGES  THEREOF

The Petition of John D. Martin of Harbor Grace, in the Island of Newfoundland, Boot and Shoe Manufacturer.

Humbly Sheweth

That Hector Curtis, late of Harbor Grace, aforesaid, Master Mariner, died at that place on or about the 24th day of January 1900, having first made and executed as and for his last Will and Testament the paper writing hereto annexed marked "A", and naming as his executors therein your Petitioner and John Tapp, also of Harbor Grace aforesaid, Blacksmith.

The said Will was duly proved upon the affidavit of the said John D. Martin, one of the subscribing witnesses thereto, and is hereto annexed marked "B".

The value of the Estate of the said Hector Curtis does not exceed in value the sum of Three thousand dollars

No Probate of any Will or Administration of the Estate of the said Hector Curtis has been at any time granted by your Honourable Court to any person.

Your petitioner therefore prays that your Honourable Court or one of the Honourable the Judges thereof will be pleased to grant to him and the said John Tapp, letters of Probate of the said last Will and Testament of the said Hector Curtis.

And as in duty bound your Petitioner will ever pray.
