AFFIDAVIT

In the Supreme Court of Newfoundland
----------------

NEWFOUNDLAND
St. Johns To Wit          I Donald M. Browning of St. Johns aforesaid Chief Clerk and Registrar of the Supreme Court do swear that I believe that Mary Ann Churchwell late of Great Burin in the Southern District Widow deceased, died without a Will; and that I will well and truly administer all and every the Goods of the said deceased and pay her debts, so far as her Goods will extend: and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased of which she died possessed, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of Eight hundred dollars.

Notice

Three days from the date hereof application will be made to the Honorable the Supreme Court or to one of the Honorable the Judges thereof for Letters of Administration of the Estate and Effects of Mary Ann Churchwell late of Great Burin in the Southern District Widow deceased to be granted to William Emberly brother of said deceased.

TO THE HONOURABLE THE SUPREME COURT OR TO ONE OF THE HONORABLE THE JUDGES THEREOF.

The Petition of William Emberly of Great Burin in the Southern District Fisherman

Humbly Sheweth

That Mary Ann Churchwell late of Great Burin aforesaid died at that place on or about the third day of September A.D. 1900 intestate leaving her surviving her half-sister Maria Smeardon and Jane Rogers and Thomas, Joseph, Richard, George, and Louisa Emberly, children of her brother Joseph deceased and her brother your Petitioner.
The Probable value of the estate of the said Mary Anne Churchwell deceased does not exceed $800.00
No Probate of any Will nor Administration of the estate of the said Mary Anne Churchwell deceased has been at any time granted by your Honourable Court.
Your Petitioner therefore prays that your Honourable Court or one of the Honourable the Judges thereof will be pleased to grant to him Letters of Administration of the estate and effects of the said Mary Anne Churchwell deceased.
And as in duty bound your Petitioner will ever pray etc.
