To Wit I James Carter of Saint Johns aforesaid Sheriff of Newfoundland make oath and say that on the twenty sixth day of January A.D. one thousand nine hundred I was present and did see Sir Frederic B. T. Carter K.C.M.G. late of St. Johns aforesaid, the Testator named in the paper writing hereunto annexed, marked A, duly sign publish and declare the said annexed paper writing as and for his last Will and Testament, in my presence and in the presence of The Honorable Joseph J. Little Chief Justice of Newfoundland aforesaid the other subscribing witness thereto. That I and said Joseph J. Little then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other, and at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

I, Sir Frederic B. T. Carter do make and declare the following as and for my last Will and Testament. I appoint my Sons Hugh Hoyles and Henry David Carter the Executors hereof.
I give and bequeath to them all and singular my real and personal Estate to be held by them in Trust for the support and maintenance of my daughter Lucretia. My Executors shall apply all the rents issues interest and profits therefrom towards her support while she remains unmarried together the interest arising from and out of all investments of the proceeds due or falling due under any policy of Insurance I have on my life and apply said interest in like manner to the maintenance and support of my said daughter

Whilst she may remain unmarried in the event of her death or marriage them my general Estate shall be distributed equally among all my children and grand children.
To my said son Hugh Hoyles, I will and bequeath all my law and other books.

The Petition of Hugh H. Carter of Saint Johns Barrister at Law and Henry D. Carter of the same place Accountant.
Humbly Sheweth
That your Petitioner's late father, the Honorable Sir Frederic Bowker Terington Carter of Saint Johns aforesaid K.C.M.G. died there on the first day of March instant having previously made and executed his last Will and Testament (Marked A) by which said Will Testator appointed your Petitioners Executors thereof.
That Testator left him surviving two sons, namely your Petitioners and three daughters namely Maude Widow of the late Edward I. Philpot, now residing in Bedford, England, Edith married to John Henderson residing in Saint Johns aforesaid and three children of a deceased daughter Ida Marion Duder namely Stanley, Josephine and Frank Duder

all under the age of twenty one years and one child of another deceased daughter Josephine Allan Mutch namely Gordon Ernest Mutch aged Eleven years.
That the said Will has been proved in Common form which said proof is hereto annexed (marked B).
That deceased died possessed of property of the probable value of six thousand dollars.
That neither Probate nor Administration has been previously granted to the Estate of the said deceased.
Petitioners therefore pray that your Lordships will be pleased to grant them Probate of the Estate of the said deceased.
And as in duty bound will ever pray &c

To Wit (We Hugh H. Carter of Saint Johns Barrister at Law and Henry D.) Carter of the same place, Accountant. (of St. John's in the Central District of Newfoundland do swear) that we believe this to be the true Last Will and Testament of The Honourable Sir Frederic Bowker Terington Carter late of St. Johns K.C.M.G. deceased.
We do further swear that we will pay all the Debts and Legacies of the said deceased so far as his Goods shall extend, and the law shall bind us, and that we will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when we shall be lawfully called thereto. And we do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Sir Frederic Bowker Terington Carter deceased, and of which he died possessed, do not, according to the best of our knowledge, judgment and belief, amount to the value of Six thousand dollars
