AFFIDAVIT

In the Supreme Court of Newfoundland

NEWFOUNDLAND
St. Johns To Wit          } I Elizabeth Carroll of St. John's aforesaid widow do swear that I believe this to be the true Last Will and Testament of William Carroll of St. Johns aforesaid carpenter deceased and I do further swear that I will pay all the Debts and Legacies of the said deceased so far as his Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said William Carroll deceased, and of which he died possessed, do not, according to the best of my knowledge, judgment and belief, amount to the value of five hundred dollars

          Three days after date application will be made to the Honorable the Supreme Court of Newfoundland or to one of the Honorable the Judges thereof for Probate to the Will of William Carroll, late of St. Johns, Carpenter, deceased, to be granted to Elizabeth Carroll, Widow of said deceased, the Executor named in said Will.
          Dated at St. Johns this 17th day of May A.D. 1900 .

St. John's To Wit          } I Edward H. Davey of St. Johns aforesaid Contractor make oath and say that on the third day of November A.D. one thousand nine hundred I was present and did see William Carroll late of St. Johns aforesaid the Testator named in the paper writing hereunto annexed, marked "A", duly sign, publish and declare the said annexed paper writing as and for his last Will and Testament, in my presence and in the presence of William Skenes also of St Johns aforesaid Labourer the other subscribing witness thereto. That I and said William Skenes then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

This is the Last Will of me William Carroll of St. Johns in the Island of Newfoundland Carpenter I give all my property to my dear wife Elizabeth Carroll and I appoint her the sole Executor of this my Will.

          The Petition of Elizabeth Carroll of St. Johns in the Island of Newfoundland Widow

Humbly Sheweth

          That your Petitioners Husband William Carroll late of St. Johns Carpenter deceased, died at that place on or about the 7th day of December last past leaving him surviving your Petitioner but no children.
          That at the time of his death the said deceased was worth property and Effects within the Jurisdiction of your Honorable Court of the probable value of Five hundred dollars as will appear by the Schedule appended hereto.
          That the paper writing hereto annexed marked "A" is the true last Will and testament of the said deceased.
          That under said Will your Petitioner is appointed Sole Executrix.

          That neither Probate or Letters of Administration have as yet been granted to said Estate.
          Your Petitioner therefore prays that Probate to the said Will may be granted to her.
          And as in duty bound she will ever pray.
