We, William C. Hawker, Accountant, and Jacob C. Taylor, Dealer make oath and say as follows :-

  1. I, William C. Hawker, make oath and say that I am the owner of goods property effects within the jurisdiction of this Honorable Court to the value of $1800.00 and that the same is not in any way incumbered.
  2. I Joseph C. Taylor make oath and say that I am the owner of goods property and effects within the jurisdiction of this Honorable Court to the value of $1800.00 and that the same is not in any way incumbered

Be it Remembered That on this First day of June in the 63rd Year of the Reign of our Sovereign Lady Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of our Lord One Thousand Nine Hundred

Personally appeared Elihu Ash of Carbonear Fisherman William C. Hawker, of same place Accountant and Joseph C. Taylor also of same place Dealer and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal Sum of Sixteen hundred dollars to be had, made and levied on his Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following :---

Now the Condition of this Obligation is such, that if the above bounden Elihu Ash as Administrator of the Estate and Effects of Margaret Ash late of Carbonear Spinster deceased, do make or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said Elihu Ash as such Administrator or to the hands or possession of any other person, or persons, for him and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the fourth day of December next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of him the said Elihu Ash or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the fourth day of December which will be in the Year of Our Lord One Thousand nine hundred and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.

1. Land homes and interest in land situate at Carbonear aforesaid$800.00
2.To any other property describe it here 

I Elihu Ash of Carbonear aforesaid make oath and say that I am the administrator with the will annexed of the estate of said deceased and that the above is to the best of my knowledge information and belief a just and true inventory and valuation of the property of the said deceased at the time of her death as far as I can at present estimate.

In the name of God Almighty Amen

I Margaret Ash of Robert of Carbonear in the Northern District of Newfoundland being weak in body and sound in mind and memory and knowing that it is appointed unto all people once to die, do hereby make and ordain this my last will and testament.
I bequeath my soul to Almighty God and my body to the Earth.
I do also bequeath my property and estate as follows :- That is to say -
I bequeath to my cousin Elihu Ash all that piece or parcel of land now owned by me as child and lawful heir of the late Robert Ash, District and Colony aforesaid extending from the church of England grounds on the north and running to within fifty feet of the main street, bounded on the East by my uncle Edward Ash and on the West by Joshua Ash.
I bequeath also to the aforesaid Elihu Ash all the houses and outhouses situate

on the aforesaid described land.
I bequeath also to the aforesaid Elihu Ash my part, being one third of that land and property situated to the South of Water Street bounded on the South by waters of Carbonear Harbour, on the East by Joseph Udell's? land, on the West by Joshua Ash's land, and on the North by Water Street.
I bequeath also, to the aforesaid Elihu Ash, my part being one third of that land and property situated on the North side of Water Street and bounded on the North by my land, stated and described in the first part of this my Will, on the East by my uncle Edward Ash's land, on the West by Joshua Ash's land and on the South by Water Street.
I bequeath also to the aforesaid Elihu Ash all that piece or parcel of land situated on the North Side of Hearts Delight Road about two and a half miles from the Main beach of Carbonear.
I bequeath also to the aforesaid Elihu Ash all my personal effects now possessed by me.

To Wit          I John Ash of Carbonear maketh oath and saith that on the 3rd day of April A.D. one thousand eight hundred and ninety nine at Carbonear I, this Deponent, was present and did see Margaret Ash late of Carbonear the Testatrix named in the paper writing hereunto annexed duly sign publish and declare (by making her mark) the said annexed paper writing as and for his last Will and Testament, in the presence of this Deponent and of Eugene Ash the other subscribing witness thereto. That Deponent and said Eugene Ash then and there signed their names to such Will as such witnesses, in the presence of the said Testatrix and of each other, and that the said will was read over and explained to the said Testatrix in my presence and in the presence of said Eugene Ash and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

The Petition of Elihu Ash of Carbonear

Humbly Sheweth

  1. That Margaret Ash of Carbonear Spinster died there on or about the 9th day of October last past having first duly made and executed her last will and testament, which is hereto annexed.
  2. That the said Margaret Ash left her surviving as next of kin three uncles and the petitioner a cousin
  3. That the said testator died possessed of property within the jurisdiction of this honorable court to the probable value of $800.00
  4. That no executor is appointed in the said will. Your petitioner is the legatee under the said will.
  5. That no probate or administration to the said estate has been granted to any one heretofore.

          Petitioner therefore prays that letters of Administration with the will annexed to the estate of the said Margaret Ash be issued to him and as in duty bound he will ever pray &c.

NEWFOUNDLAND
Carbonear To Wit          I Elihu Ash of Carbonear aforesaid Fisherman do swear that I believe that Margaret Ash late of Carbonear Spinster deceased, died with a Will; and that I will well and truly administer all and every the Goods of the said deceased and pay her debts, so far as her Goods will extend: and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased of which she died possessed, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of eight hundred dollars.

So help me God
