Notice

Three days from the date hereof application will be made to the Honorable the Supreme Court or to one of the Honorable the Judges thereof for Probate to the Will of the late Jeremiah Toraville to be granted to JeremiahToraville the Executor in the said will named.

The Petition of Jeremiah Toraville of Herring Neck in the Southern District of Newfoundland

Humbly Sheweth

  1. That Jeremiah Toraville late of Herring Neck in the Southern District aforesaid planter died on or about the thirteenth day of December Anno Domini Eighteen hundred and ninety seven having made and published his last will and testament hereto annexed marked A proven in common form.
  2. That the said deceased was possessed at the time of his death of property of the probable value of Four hundred dollars
  3. That the said Jeremiah Toraville left him surviving three sons Joseph Benjamin Jeremiah and three daughters Elizabeth Amelia and Lucy
  4. That in and by his said last will and testament the said testator appointed your Petitioner to be ??? thereto.
  5. That no probate or administration has been granted to the Estate or any

    will? of the said Jeremiah Toraville.

          Your Petitioner therefore prays that Probate of the said Will be granted to him F??? of this Honorable Court and as in duty bound he will ever pray &c &c &c

St. John's To Wit          I Robert Grundy of Herring Neck, Agent, make oath and say that on the 6th day of November A.D. one thousand eight hundred and ninety five at Herring Neck I was present and did see Jeremiah Toraville late of Herring Neck the Testator named in the paper writing hereunto annexed, marked A, duly sign (by making his mark) publish and declare the said annexed paper writing as and for his last Will and Testament, in my presence and in the presence of George S. Chamberlain, Clerk in Holy Orders, the other subscribing witness thereto. That I and said S. Chamberlain then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other. That previously to the said Will being so signed, as aforesaid, by the said Testator and the said witnesses, it was read over to and approved of by the said Testator in the presence of me and the said George S. Chamberlain and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.

This is the last Will and Testament of Jeremiah Toraville, planter, Herring Neck, in the electoral district of Twillingate, Newfoundland. I hereby give, devise, and bequeath to my eldest son Joseph, the land upon which his house now stands, including six feet towards my home?, the whole of it in the direction of James Smart, the waterside frontage at? the Cove, the lower length of the Potatoe [sic] garden, & the grass? garden in the Gut - Arm & one herring net.
I give, devise, & bequeath to my son Benjamin, the part of the room towards Robert Rice's ??? the half of the house he now occupies, part of the potatoe [sic] garden, the part of the meadow in Gut Arm, & part of the meadow up the road? ; both - now respectively occupied by him, one herring net, half the stage, the old store house & sheep barn.
I give, devise, & bequeath to my youngest son, Jeremiah, the half of this dwelling house now in my occupation, the whole of the remainder of my room, with buildings, stages & flakes lying between the aforesaid bequests to my two sons Joseph & Benjamin. Of the remaining portions of my gardens, meadows, & the remainder of my estate and effects, both real and personal, whatsoever, wheresoever, and of what nature and quality now

And I hereby decree that the above bequests are to my sons, Joseph, Benjamin, & Jeremiah respectively to their heirs, executors, & administrators for their own use and benefits absolutely and forever, that they are never to go out of the family whilst there is a heir.
I give, devise, & bequeath to my daughter Elizabeth my watch & bible and I hereby appoint my son Jeremiah the sole executor of this my will.
In witness whereof I have hereunto set my hand this sixth day of November one thousand eight hundred and ninety five.

To Wit          I Jeremiah Toraville do swear that I believe this to be the true Last Will and Testament of Jeremiah Toraville late of Herring Neck Planter deceased. I do further swear that I will pay all the Debts and Legacies of the said deceased so far as his Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased, and of which he died possessed, do not, according to the best of my knowledge, judgment and belief, amount to the value of Four Hundred Dollars
