Newfoundland
St. Johns   To Wit          I Mary Walsh of St. John's aforesaid Married Woman, do swear that I believe this to be the true Last Will and Testament of John Stack late of Outer Cove near St. Johns in the Central District Fisherman deceased. I do further swear that I will pay all the Debts and Legacies of the said deceased so far as her Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased, and of which he died possessed, do not, according to the best of my knowledge, judgment and belief, amount to the value of Four hundred and fifty dollars

Three days after the date hereof application will made to the Honorable the Supreme Court or to one of the Honorable the Judges thereof for Probate to the last Will and Testament of John Stack late of Outer Cove, Newfoundland, fisherman, deceased, to be granted to Mary Walsh of St. Johns, daughter of said deceased
          Dated at St. Johns this 3rd day of November A.D. 1899.

To the Honourable the Supreme Court of Newfoundland or to one of the Honourable the Judges thereof.
The Petition of Mary Walsh of St. Johns in the Island of Newfoundland, married woman, humbly sheweth as follows :-
          That John Stack late of Outer Cove in the Island aforesaid fisherman, deceased, died at Outer Cove aforesaid on the 15th day of September A.D. 1899 having previously made his last Will and testament which is hereto annexed proven upon the oath of Robert J. Parsons one of the subscribing witnesses thereto.
          That under the said will your petitioner was appointed sole executrix.
          That at the time of his death the said deceased was possessed of property within the jurisdiction of this Honourable Court of the probable value of $800? .
          That no probate to any will or letters of administration have been granted to any person.
          Petitioner therefore prays that probate to the said will may be granted to her and as in duty bound she will ever pray.
          Dated at St. Johns this 8th? day of November A.D. 1899

To Wit          I Robert John Parsons of Saint Johns in the Island of Newfoundland make oath and say that on the 13th day of September A.D. one thousand eight hundred and ninety eight at Saint Johns, I was present and did see John Stack late of Outer Cove the Testator named in the paper writing hereunto annexed, marked A, duly sign (by making his mark) publish and declare the said annexed paper writing as and for his last Will and Testament, in my presence and in the presence of William J. Pumphrey, the other subscribing witness thereto. That I and said William J. Pumphrey then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other and that previous to the said Will being so signed as aforesaid, by the said Testator and the said witnesses, it was read over to and approved of by the said Testator in the presence of me and the said William J. Pumphrey, and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

In the name of God Amen. This is the last Will and Testament of me John Stack of Outer Cove in the Island of Newfoundland, fisherman,
1st I bequeath all my lands Goods Chattels monies and effects of whatever kind that I may die possessed of to my daughter Mary Walsh, wife of John Walsh to her only use and behoof [sic] free from the debts of her present or any husband.
I now revoke all other wills made by me and I appoint the said Mary Walsh Executrix of this my last Will and Testament.
