Greenspond   To Wit          I Alfred H. Seymour of Greenspond, Stependiary Magistrate do swear that I believe this to be the true Last Will and Testament of John Spence late of Harbor Grace, Gentleman deceased. I do further swear that I will pay all the Debts and Legacies of the said deceased so far as his Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said John Spence deceased, and of which he died possessed, do not, according to the best of my knowledge, judgment and belief, amount to the value of Four thousand dollars

To Wit
          I Henry Corbin Watts of Harbor Grace make oath and say that on the 27th day of May AD 1898 at Harbor Grace aforesaid I was present and did see John Spence late of Harbor Grace aforesaid, the Testator named in the paper writing hereunto annexed marked A duly sign by making his mark publish and declare the said annexed paper writing as and for his last Will and Testament in my presence and in the presence of Andrew F. Drysdale the other subscribing witness thereto.
That I and the said Andrew F. Drysdale then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other. That previously to the said Will being so signed as aforesaid by the said Testator and the said witnesses, it was read over to and approved of by the said Testator in the presence of me and the said Andrew F. Drysdale, and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding to the best of my knowledge and belief.

Know all Men by these presents That I John Spence ol Harbor Grace, Newfoundland Gentleman being of sound and disposing mind memory and recollection, do make publish and declare this to be my last Will and Testament.

  1. I will bequeath and give to my son John Spence the lands and house now occupied by him with ??? Coal house in the rear for ever. He is to pay my Wife Frances E. Spence rent Sixteen Dollars per year as long as she remains in my name.
  2. I will bequeath and give to my son Kenneth Spence the lands and house now occupied by him with 1/3 of the Coal house in the rear for ever he is to pay my Wife Frances E. Spence rent twelve Dollars a year as long as she remains in my name.
  3. I will bequeath and give to my Wife Frances E. Spence lands and house now occupied by me with 1/3 of the Coal house in the rear while she remains in my name and from and immediately after her death to my son Samuel Spence for ever
  4. I confirm a deed of Gift of lands made by me to my late son Stephen Spence
  5. I will bequeath and give to my son Samuel Spence forty four feet of lands from East to West, bounded by Harry Kent on the North Bennetts lane on the West and on the South by house and land occupied by Thomas Lynch, to be used by my wife Frances E. Spence until Samuel requests it for building purposes.

  6. I will bequeath and give to my wife Frances E. Spence as long as she remains in my name the furniture and household goods now in my house and immediately after her death to be equally divided between my sons and daughters
  7. I will devise bequeath and give to my wife Frances E. Spence all my monies in the Harbor Grace Branch Savings Bank and the Newfoundland Savings Bank for her sole use and behoof, [sic]
  8. I hereby appoint Alfred H. Seymour Esq. Stipendiary Magistrate of Greenspond to be Sole Executor to this my last Will and Testament and revoke all previous Wills by me at any time heretofore made.

          In Witness whereof I have hereunto set my hand this Twenty Seventh day of May. 1898.

Notice

After three days application will be made to the Honourable the Supreme Court or one of the Judges thereof that letters of probate of the will of John Spence late of Harbor Grace Gentleman deceased be granted to Alfred H. Seymour the executor named in the said will.

I certify that the notice on the other side hereof written was duly posted in the office of the Chief Clerk of the Supreme Court on the day of its date, and has since so remained posted; and that no caveat or other objection has been made thereto.

To the Honble [sic] Supreme Court of Newfoundland

The Petition of Alfred H. Seymour humbly sheweth that John Spence late of Harbor Grace on said Island Gentleman died on or about (Day of month badly smudged and unreadable) January last, having made his last will and testament hereto annexed marked A. That the said John Spence left him surviving his widow three sons named John, Samuel, and Kenneth, also three daughters named Melina, Hannah and Jessie. That said John Spence appointed your Petitioner Executor of his said Will as herein named, That the value of deceased Estate does not exceed four thousand dollars. Your Petitioner therefore prays that letters of probate with the said will be granted to him and as in duty bound he will ever pray.
