At the instance of William Newell claiming as next of kin of the said Nicholas Newell I do order that Jacob Newell of Pouch Cove Fisherman do show cause if any he has whereof administration to the estate of the said Nicholas Newell deceased should not be granted to the said William Newell or to such person as the Honourable the Supreme Court or a judge thereof may appoint by filing in the Registrar's office and serving on the William Newell an answer containing the grounds on which he resists such grant within ten days after service of this citation; otherwise the claim of the said William Newell will be taken to be admitted by him.

SUPREME COURT OF NEWFOUNDLAND
Be it Remembered, that on this __third ___ May ____ in the Fifty __third__ Year of the Reign of our Sovereign Lady Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c., and in the Year of Our Lord One Thousand Eight Hundred and Ninety personally appeared William Newell of Pouch Cove in the Central District of the Island of Newfoundland fisherman William Langmead of Pouch Cove aforesaid fisherman and William Baldwin of same place fisherman and did acknowledge themselves to be held and firmly bound to our said Lady the Queen, Her Heirs and Successors, in the penal sum of Four hundred Dollars, to be had, made and levied on their Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following:
NOW THE CONDITION OF THIS OBLIGATION IS SUCH, that if the above bounden William Newell as Administrator of the Estate and Effects of Nicholas Newell late of Pouch Cove aforesaid deceased, do make, or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said William Newell as such administrator or to the hands or possession of any other person or persons, for him and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the 3rd day of November next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of him the said William Newell or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of my said administration, on or before the 3rd day of May which will be in the Year of Lord One Thousand Eight Hundred and Ninety one and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.

The Petition of William Newell of Pouch Cove aforesaid Fisherman,
Humbly Sheweth
That Nicholas Newell late of Pouch Cove aforesaid Fisherman died there on or about the sixteenth day of February A.D. 1888 intestate leaving him surviving a widow two sons William, your petitioner, Richard and two daughters Margaret wife of Thomas Cooper, and Elizabeth since deceased. That the said Nicholas at the time of his decease was possessed of property at Pouch Cove aforesaid of the probable value of Two hundred dollars
That no administration to the estate of said Nicholas Newell has been applied for by nor granted to any other person.
Petition that the widow of said Nicholas Newell is willing and consents that administration to the estate of said deceased be granted to your petitioner.
And as in duty bound will ever pray etc.

Upon reading the petition of William Newell of Pouch Cove aforesaid and the affidavit of verification thereof, the citation and the affidavit of serve thereof herein and upon hearing W. Shea of Counsel for the said William Newell the applicant for administration to the above estate the said Jacob Newell not having filed an answer to the said citation nor appeared thereto, I do order that administration to the estate of said Nicholas Newell be granted to the said William Newell.

I do swear that I believe that Nicholas Newell late of Pouch Cove in the Central District fisherman deceased, died without a Will; and that I will well and truly administer all and every the Goods of the said deceased and pay his debts so far as his Goods will extend, and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be hereunto lawfully required and that the whole of the goods, rights, chattels, assets, credits and effects of the said deceased which he died possessed of, within the jurisdiction of this Court do not, according to the best of my knowledge, judgement and belief, amount to the value of Two hundred & fifty dollars.
