NEWFOUNDLAND
St. Johns To Wit We Frank J. Morris of St. John's Solicitor and Patrick Murphy of same place Road Inspector do swear that we believe this to be the true Last Will and Testament of Philip St. John late of St. Johns aforesaid, Farmer, deceased. We do further swear that we will pay all the Debts and Legacies of the said deceased so far as his Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when we shall be lawfully called thereto. And we do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Philip St. John deceased, and of which he died possessed, do not, according to the best of our knowledge, judgment and belief, amount to the value of Twelve hundred and fifty dollars

St. John's To Wit I Patrick Murphy of St. Johns in the Central District Road Inspector make oath and say that on the third day of October A.D. one thousand eight hundred and ninety five at St. John's aforesaid I was present and did see Philip St. John late of St. Johns Farmer the Testator named in the paper writing hereunto annexed duly sign, publish and declare the said annexed paper writing marked A as and for his last Will and Testament, in my presence and in the presence of Frank J. Morris the other subscribing witness thereto. That I and said Frank J. Morris then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other, and at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

I Frank J. Morris of S. Johns Solicitor make oath and say that I was present and did see the late Philip St. John late of St. Johns Farmer deceased the testator named in the paper writing hereunto annexed Marked 'A' duly sign the interlineation [sic] between the twenty first and twenty second line and reading as follows "Daughter Ann St. John whilst she remains unmarried that farm known as Richmond Hill? after her marriage between my" That I and Patrick Murphy the other subscribing witness to said Will then and there affixed our initials thereto in presence of said Philip St. John as witnesses and that the said deceased was of sound mind and industry?

This is the last will of Philip St. John referred to in the annexed Affidavit of Patrick Murphy.
In the name of God Amen.
This is the last Will and Testament of me Philip St. John of Saint Johns in the Island of Newfoundland farmer. First I devise and bequeath to my son John St. John the farm dwelling and premises now occupied by me together with all the outhouses and erections thereon; the stock, cows, horses, and all and every article and appurtenance whatsoever to the said farm belonging, also all my household furniture save and except two feather beds also all that piece of land situate on the Southside of Waterford Bridge Valley extending along the southern side of the main road bounded on the west by land of John Hearn and on the
east by land the property of ??? of the convent at St. Patricks Riverhead Second I devise and bequeath to my daughter Ann St. John whilst she remains unmarried that farm known as Richmond Hill after marriage ??? my four daughters Ellen, the wife of William Buckley, Kate, the wife of Patrick Buckmaster, Mary, the wife of John Brennan, and Ann St. John all that farm of land situate in the West and of the town of St. Johns aforesaid and known as Richmond Hill to be divided between them share and share alike. Third I devise and bequeath to my son William St. John all that piece of land situate on the North side of the Main road on the South Side Waterford Bridge Valley bounded on the west
by my farm before mentioned and on the East by land the property of John C. Hearn aforesaid. Fourth, I devise and bequeath to the Bishop of St. Johns the sum of ten pounds currency for a High Mass for the repose of my soul. Fifth:- I devise and bequeath to my said daughter Ann St. John all the rest residue and remainder of all my estate in money or otherwise that may at the time of my death be belonging to me after all my just debts funeral, and testamentary expenses have been paid.
I hereby cancel annul and declare void all and every further or other paper writing purporting to be my last will and testament. I appoint Francis J. Morris of Saint Johns Barrister at Law, & Patrick J. Murphy to be my executors of this my last will and testament

Humbly Sheweth as follows
That Philip St. John late of S. Johns aforesaid Farmer deceased died at the above named place on the 5th day of February instant
That previous to his death the said deceased made and Executed his last Will and Testament which is hereunto annexed proven upon the affidavit of Patrick Murphy one of the subscribing witnesses thereto.
That in and by said last Will the said deceased nominated and appointed your Petitioners as Executors thereof.
That at the time of his death the said deceased was possessed of property within the jurisdiction of this Honorable Court of the probable value of Twelve hundred dollars ($1200.00)
That neither probate to any last will nor Letters of Administration to the Estate and Effects of said deceased has been granted to any person
Your Petitioner would therefore
pray your Honorable Court to grant him Probate to said last Will and Testament of said deceased as Executors thereof and as in duty bound will ever pray &c

- That we are the executors of the last will and testament of the late Phiiip St. John late of St. Johns Farmer deceased duly appointed by the Honourable the Supreme Court under said will.
- That we have well and truly administered the effects of the Estate of said deceased and carried out the provisions and instructions laid down in his said will and have compiled the statement of account within written of the said estate showing the value of the property as far as we could judge the same that came late our possession as executors and the disbursments made and Bequests ??? ??? on account thereof.
- That the several items and things in the said statement of account are just correct and true.

The Petition of Patrick J. Murphy of St. Johns Farmer Humbly Showeth as follows :-
That your petitioner was appointed Executor of the last will of the late Philip St. John late of St. Johns Farmer deceased.
That the said deceased died in the month of February A.D.1895
That Probate to said will was granted on the 10th day of February A.D. 1895
That the Estate bequeathed consisted of one farm, dwelling house and premises and several other pieces of farm land, cows, horses, and farm stock, situate South Side Waterford Bridge Road also a deposit receipt in the Union Bank for $890 since reduced to $640.
That your Petitioner well and truly administered the Estate of said deceased and paid his debts and the several bequests and legacies and otherwise carried out the several provisions and instructions set forth in said will, and prepared a true and full statement of the accounts credits and debts of the said Estate for filing in the Registry of this Honourable Court as by Law required.
Petitioner is desirous of receiving a fair and reasonable amount of compensation for his services rendered as such Executor.
Your Petitioner would therefore pray your Honourable Court to grant him an amount as compensation for such services as will to your Lordship appear fair and reasonable and as in duty bound he will ever pray.

I Frank J. Morris of St. Johns Solicitor do hereby say that I am a co-trustee with Patrick Murphy, the Petitioner herein to the last will and testament of Philip St. John deceased, and that I forego and renounce all claim to compensation from said Estate of said deceased as and of the executors thereof. I would recommend the said Patrick Murphy to the consideration of the Court and think him entitled to a fair and reasonable amount commission in compensation.
