NEWFOUNDLAND
St. Johns   To Wit          We, John Brunless? and George Paterson of Harbor Grace aforesaid jointly and severally do swear that we believe this to be the true Last Will and Testament of Neil Stewart late of Harbor Grace aforesaid Shop Keeper deceased. And we do further swear that we will pay all the Debts and Legacies of the said deceased so far as Goods shall extend, and the law shall bind me, and that we will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when we shall be lawfully called thereto. And we do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Neil Stewart deceased, and of which he died possessed, do not, according to the best of our knowledge, judgment and belief, amount to the value of Ten thousand five hundred dollars

Notice

Three days after date hereof application will be made to one of the Honorable The Judges of the Supreme Court of Newfoundland for Probate to the Will of Neil Stewart late of Harbor Grace Shop Keeper deceased to be granted to John Brunlees and George Paterson both of Harbor Grace aforesaid, the Executors named in said Will
          Dated at St. Johns this 21st day of March 1895

I Neil Stewart of Harbr Grace Newfoundland being of sound mind and mindful of the shortness of life hereby bequeath to the Pres-byterian Church for the use of the Presbyterian con- gregation of Harbr Grace one thousand dollars and to Lodge Harbr Grace of the Masonic body one thousand dollars and to the British Society of Harbr Grace Five hundred dollars and all the remainder of my property real and personal after all my debts are paid to my wife Mary Stewart and to her heirs for ever and I hereby appoint Mr. John Brunlees and Mr. George Paterson both of Harbr Grace to carry out the provisions of this my last will and testa-ment made this thirtieth day of December 1894.

St. John's   To Wit          I John Paterson of Harbor Grace aforesaid Merchant make oath and say that on the thirtieth day of December A.D. one thousand eight hundred and ninety four at Harbor Grace aforesaid I was present and did see Neil Stewart late of Harbor Grace aforesaid the Testator named in the paper writing hereunto annexed duly sign publish and declare the said annexed paper writing marked A as and for his last Will and Testament, in the presence of me and of James D. Munn also of Harbor Grace aforesaid Executor the other subscribing witness thereto. That I and said James D. Munn then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other, and at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.

The Petition of George Paterson of Harbor Grace in the Island of Newfoundland accountant

Humbly Sheweth

          That Neil Stewart late of Harbor Grace aforesaid Shop Keeper died at that place on or about the 7th day of the present month of March leaving him surviving his Widow but no children
          That at the time of his death the said deceased was possessed of money property and effects within the jurisdiction of your Honorable Court of the probable value of Ten thousand dollars.
          That the paper writing hereto marked "A" is your petitioner verily believes the last Will and Testament of the said Neil Stewart and which said Will is proven in due form of law by the affidavit of John Paterson of Harbor Grace Merchant

 

one of the subscribing witnesses thereto
          That under said Will John Brunlees of Harbor Grace aforesaid Shop Keeper and your Petitioner were appointed Executors
          That neither Probate nor Letters of administration have as yet been granted to said Estate
          Your Petitioner therefore prays that Probate to the said Will may be granted to the said John Brunlees and your Petitioner.
          And as in duty bound your Petitioner will ever pray
