NEWFOUNDLAND
St. John's   To Wit          I Thomas Searle of St. Johns in the Central District Farmer do swear that I believe that James Searle late of Belle Isle in the Central District farmer deceased, died with a Will; and that I will well and truly administer all and every the Goods of the said deceased and pay his debts, so far as his Goods will extend: and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased which he died possessed of, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of Four hundred and fifty dollars.

So help me God

I James Serle of B??? being infirm and weak of body, but of perfect mind, and Memory thanks be given unto God therefore Calling to mind the mortality of the body, knowing that it is appointed ??? ??? ever? to die; do therefore ordain that my sole? last will and testament ??? that is to say principally, and first of all I give and recommend my soul into the hands of Almighty God that gave it, and my body I recommend to the earth to be buried in decent Christian burial, at the discretion of my executors, as touching such worldly property with which it both pleased God to help me in this life; I now give devise, and dispose of it in the following manner.
I give and bequeath to my oldest son Thomas Searl Thommies? Place?
The Plantation I bequeath to my youngest Son Benjamin Searl the meadow wich [sic] the dwelling is bilt [sic] a long [sic] with the House the horse and cows and Sh??? and the meadow that is on the back of the ? land and the Broad Head? Meadow. Bounded on the East by James Norman and on the West by ??? Norman
And I revoke and disannul all and every thing former? wills legacies bequests and wills before by me willed and bequeathed Ratifying and Confirming this and no other to be my last Will and Testament.

The Petition of Thomas Searle of Saint Johns farmer

Humbly Sheweth

That petitioners father James Searle late of Belle Isle in the Central District farmer deceased died at Belle Isle aforesaid in the month of December 1889
That before his death he made and executed the paper writing hereto annexed as an Ifn? his last will and testament
That no executors are named in said will
That he died possessed of property of the probable value of Four hundred dollars
That he left him surviving your petitioner three other children John and Mary and Benjamin
That deceased property consisted almost entirely of landed? property which is bequeathed to your Petitioner and his brother Benjamin
That Petitioner's brother Benjamin consents to his ??? administration with the will annexed to the Estate and effects of the said James Searle.
Petitioner therefore prays that Administration with will annexed may be granted to him
And as in duty bound he will ever pray,

St. John's   To Wit          I William Bennett of Belle Isle Farmer make oath and say that on the Tenth day of January A.D. one thousand eight hundred and Eighty-one at Belle Isle I was present and did see James Searle late of Belle Isle, Farmer, the Testator named in the paper writing hereunto annexed Marked A, duly sign (by making his mark) publish and declare the said annexed paper writing as and for his last Will and Testament, in my presence and in the presence of Francis Norman, the other subscribing witness thereto. That I and said Francis Norman then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other. That previously to the said Will being so signed, as aforesaid, by the said Testator and the said witnesses, it was read over to, and approved of by the said Testator in the presence of me and the said Francis Norman and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.

Be it Remembered That on this Twelfth day of December in the 59th Year of the Reign of our Sovereign Lady Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of our Lord One Thousand Eight Hundred and ninety five personally appeared Thomas Searle of St. Johns in the Central District, farmer, Benjamin Searle of St. Johns Farmer and Thomas Carnell of St. Johns Wh?? bought? and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal Sum of Nine hundred dollars to be had, made and levied on his Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following :---

Now the Condition of this Obligation is such, that if the above bounden Thomas Searle as Administrator cum testamento annexo of the Estate and Effects of James Searle late of Bell Isle Conception Bay Farmer deceased, do make or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said Thomas Searle as such Administrator or to the hands or possession of any other person, or persons, for him and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the 12th day of June next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of him the said Administrator or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the 12th day of December which will be in the Year of Our Lord One Thousand Eight Hundred and ninety six and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.
