St. Johns To Wit I do swear that I believe this to be the true Last Will and Testament of Thomas Rossiter of St. Johns Dealer. I do further swear that I will pay all the Debts and Legacies of the said deceased so far as Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Thomas Rossiter, deceased, and of which died possessed, do not, according to the best of my knowledge, judgment and belief, amount to the value of $1600.00 dollars

In the name of God amen. I Thomas Rossiter of St. Johns in the Island of Newfoundland declare this to be my last will and Testament.
First it is my will and desire that out of my general estate my just debts and funeral expenses shall be first paid.
Secondly, I give devise and bequeath to my wife Ann Rossiter the dwelling house situate on Wickford Street No. 37. where I at present reside with all the furniture therein. And also that other dwelling house situate on Wickford Street aforesaid and numbered 33 - To have and to hold the same to her for and during the term of her natural life and after her death the said dwelling houses and furniture shall become the property of my two sons John and William Rossiter share and share alike.
Thirdly, I devise and bequeath to my son John Rossiter that dwelling house situate on Goodview Street to be his sole property after he attains the age of Twenty One years.
Fourthly, I devise and bequeath to my son William Rossiter that dwelling house situate on Wickford Street No. 35 to be his sole property after he attains the age of Twenty One years.
Fifthly, I devise and bequeath all other property moneys goods chattles [sic] and effects of which I might die possessed to my said wife Ann Rossiter to hold the same to her for and during the term of her natural life
Sixthly, It is my will and desire that
should either of my said sons predecease the other before attaining the age of Twenty One years then and in such case the houses and property willed to him shall become the property of the surviving one.
I hereby appoint Captain Joseph Power of St. Johns to be sole Executor of this my last Will and Testament hereby also revoking and annulling all other Wills and Testaments by me heretofore made.

St. John's To Wit I Frank I. Morris of St. Johns Solicitor make oath and say that on the Eighth day of December A.D. one thousand eight hundred and ninety four at St. John's aforesaid I was present and did see Thomas Rossiter late of St. Johns Dealer the Testator named in the paper writing hereunto annexed duly sign, publish and declare the said annexed paper writing, marked A as and for his last Will and Testament, in the presence of me and of Joseph Power Planter of St. Johns aforesaid, the other subscribing witness thereto. That I and said Joseph Power then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other, and at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

The Petition of Joseph Power of St. Johns
Humbly Sheweth as follows
That Thomas Rossiter late of St. Johns Shopkeeper deceased died at that place on the third day of May Instant.
That previous to his death the said deceased made and executed his last will and Testament which is hereunto (I have tried but can't transcribe the next two lines with any confidence)
one of the subscribing witnesses thereto.
That in and by the said last will your said Petitioner was appointed sole executor thereof.
That at the time of his death the said deceased was possessed of property within the Jurisdiction of this Honorable Court of the value of about Sixteen hundred dollars.
That neither probate to any last will, nor letters of administration to the Estate of said deceased
has yet been granted to any person.
Your Petitioner therefore prays that your Honorable Court will grant him Probate to said last Will of said deceased and as in duty bound will ever pray &c
