NEWFOUNDLAND
St. Johns   To Wit          I Edith Livingstone O'Dwyer of St. John's, Widow, do swear that I believe this to be the true Last Will and Testament of John L. O'Dwyer late of St. Johns, aforesaid, Merchant, deceased. I do further swear that I will pay all the Debts and Legacies of the said deceased so far as his Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased, and of which he died possessed, do not, according to the best of my knowledge, judgment and belief, amount to the value of Eleven thousand dollars

This is the last Will of me John O'Dwyer of Saint Johns, Newfoundland, Commission Merchant. I devise and bequeath all my estate and effects real and personal which I may die possessed of or entitled to unto my wife Edith Livingstone O'Dwyer absolutely and I appoint her my sole Executrix under this my Will,
Saint John's 20th January 1895

To Wit          I James P. Fox of Saint Johns Gentleman make oath and say that on the 20th day of January A.D. One Thousand Eight Hundred and ninety five at Saint John's I was present and did see John L. O'Dwyer late of Saint Johns Commission Merchant the Testator named in the paper writing hereunto annexed duly sign publish and declare the said annexed paper writing Marked A as and for his last Will and Testament, in the presence of me and of Charles Duder the other subscribing witness thereto. That I and said Charles Duder then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

Notice

Three days from the date hereof application will be made to the Supreme Court or one of the Honorable the Judges thereof for Probate to the last will and testament of John L. O'Dwyer late of Saint Johns Commission Merchant deceased to be granted to Edith Livingstone O'Dwyer the Executrix named in the said will.
          Dated at Saint Johns this 24th day of January AD 1895

To the Honorable the Supreme Court or to one of the Honorable the Judges thereof.

The Petition of the undersigned Edith Livingstone O'Dwyer of St. Johns in the Island of Newfoundland widow of the late John L. O'Dwyer

Humbly Sheweth

That John L. O'Dwyer late of St. Johns aforesaid Merchant died on Sunday the 20th day of January instant having previously made his last will and testament.
That the said will has been duly proven by James P. Fox Esquire one of the subscribing witnesses thereto.
That the Testator bequeathed property and money by the said will of the probable value of Ten thousand six hundred dollars
That no probate to the said will has been prayed for or granted out of your Honorable Court to the said will.
          Petitioner prays that Probate be granted to her as sole Executrix aforesaid
          And as in duty bound Petitioner will ever pray.
          Dated at St. Johns this 2nd day of January AD 1895
