NEWFOUNDLAND
St. Johns          To Wit          I George H. Emerson of St. John's Solicitor do swear that I believe this to be the true Last Will and Testament of Margaret O'Donnell late of St. Johns, Widow, deceased. I do further swear that I will pay all the Debts and Legacies of the said deceased so far as her Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Margaret O'Donnell, deceased, and of which she died possessed, do not, according to the best of my knowledge, judgment and belief, amount to the value of Three thousand five hundred dollars

"A"

This is the last Will and Testament of me Margaret O'Donnell of William St. St. Johns Widow - First I give and bequeath the house in which I live and the garden attached to my son Richard O'Donnell - I give and bequeath my other house and yard attached to my daughter Mrs. William Maher - I give and bequeath to Rev'd M.J. Clarke of Torbay the sum of two hundred dollars for Masses for myself and my late husband - It is my wish that a high mass be celebrated for me by him immediately after my death - I give and bequeath to the Community of ??? at Torbay the sum of fifty pounds ($200) - after the payment of my just debts funeral and testamentary expenses I give and bequeath the rest and remainder of my money of which I may die possessed to be equally divided between my daughter Mrs. William Maher and my son Richard O'Donnell.
I appoint George H. Emerson Executor of this my last Will and Testament - Dated at St. Johns this 26th day of July AD 1892

St Johns   To Wit          I George J. Coughlan of St. Johns aforesaid, Clerk, make oath and say that on the 26th day of July A.D. 1892 at St. Johns I was present and did see Margaret O'Donnell late of William Street, St. Johns, widow, the Testatrix named in the paper writing hereunto annexed, marked "A", duly sign, (by making her mark) publish and declare the said annexed paper writing, as and for her last Will and Testament in my presence and in the presence of George H. Emerson the other subscribing witness thereto :-
That I, the said George J. Coughlan and the said George H. Emerson then and there signed our names to such Will as such witnesses, in presence of the said Testatrix and of each other; that previously, by the said Testatrix and the said witnesses, it was read over to, and approved of by the said Testatrix in the presence of me and the said George H. Emerson and that at the time of the said execution of the said will the said Testatrix was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.

The Petition of George H. Emerson of St. Johns Solicitor

HUMBLY SHEWETH

  1. That Margaret O'Donnell of William Street, St. Johns, Widow, died on the sixth day of June last past
  2. That said deceased left a will and appointed your petitioner executor of the same.
  3. That neither Probate of the said will nor administration to the estate of the deceased has as yet been granted to anyone.
  4. That the estate of which deceased died possessed amounts to the probable value of $3000.00

          Your petitioner therefore prays that your Honorable Court will be pleased to grant him Probate to the Will of the said Margaret O'Donnell
          And as in duty bound he will ever pray
