St. Johns To Wit I Elizabeth Munn of Harbor Grace Widow, do swear that I believe this to be the true Last Will and Testament of Robert S. Munn late of Harbor Grace Merchant deceased. I do further swear that I will pay all the Debts and Legacies of the said deceased so far as his Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Robert S. Munn deceased, and of which he died possessed, do not, according to the best of my knowledge, judgment and belief, amount to the value of Four Hundred Thousand dollars

Dear Sir :-
I duly received your telegram advising me to renounce the executorship, but as I had no particulars, and as I thought there was no particular hurry, I wired you to consider Mrs. Robert in the matter, and have your later reply today and also telegram from Graham and Willie, and at once saw Mr. Monk and had the deed executed, which I herewith enclose you. Mr. Monk wired you today that the deed had been executed. I hope that everything will be all right, and trusting that we may soon have better news of the condition of financial matters and commercial matters at St. John's shortly, and wishing you and all your circle a happy and prosperous New Year.

I, Stewart Munn, of the City and District of Montreal, in the Province of Quebec and Dominion of Canada, Merchant, being duly sworn, do depose and say :-
That I decline to accept the office of Executor under the Last Will and Testament of my late Brother, Robert Stewart Munn, in his lifetime of Harbor Grace, in the Island of Newfoundland, who departed this life at Harbor Grace aforesaid on the Seventeenth day of December instant.
And I do hereby declare that I renounce said Executorship, and by this act do so renounce the said Executorship, and decline to act as such Executor.
And further I say not, and have signed.

As I am now about going on a voyage and not knowing what God in his Providence may cause to prevent my return and feeling the uncertainty of life, leave as my last Will and Testament that Stewart Munn of Montreal ??? as joint Executor with my wife and all property belonging to me is at their disposal for the benefit of my wife & children and leave all to their own good management - my wife with my brother to have full power in all matters.

To Wit I John F. Apsey of Harbor Grace in the Island of Newfoundland aforesaid Merchant, make oath and say that I have been for many years intimately acquainted with the late Robert S. Munn recently deceased in connection with the business firm of John Munn & Co of which firm he the said late Robert S. Munn was the head. That I have carefully examined and scrutinized the Paper-writing hereunto annexed of date the twenty second day of January in the year of our Lord one thousand eight-hundred and twenty five purporting to be the Last Will and Testament of the said Robert S. Munn deceased. That the hand-writing of the said Paper writing
and also of the signature thereunto attached are the true hand-writings of the said Robert S. Munn deceased.

To the honourable the Supreme Court or one of the honourable the Judges thereof,
The petition of Elizabeth Munn of Harbor Grace, Newfoundland Widow,
Humbly Sheweth
- That petitioner's husband, Robert S. Munn, late of Harbor Grace, Merchant, deceased, that at that place on the 17th day of December, A.D. 1894, having first made his last Will and Testament, which is hereunto annexed, marked "A", proved upon the affidavit of John F. Apsey, Esquire
- That the said Will is wholly in the handwriting of the said Robert S. Munn, and that the signature at the end or foot of the said Will is the signature and handwriting of the said Robert S. Munn
- That under the said Will your Petitioner and Stewart Munn, Esquire (brother of the deceased), of Montreal, Canada, Merchant, are appointed Executors to carry out the provisions of the said Will.
- That the said Stewart Munn is domiciled in Canada, and has duly renounced his Executorship, and has not, either before or since the renunciation, intermeddled in the estate of the deceased.
- That the assets of the estate of deceased are considerable, amounting probably to Four hundred thousand dollars, but as the said estate consists principally of produce of the fisheries, ships, lands, premises, and general merchandize, your Petitioner is at present unable to place any accurate valuation on the said Estate.
PRAYER
Your petitioner therefore humbly prays that your Honourable Court, or your Lordship, may be pleased to grant Probate of the annexed will to petitioner as Executrix as aforesaid.

- That I am the widow of Robert S. Munn, late of Harbor Grace, Merchant, deceased.
- That I verily believe the annexed paper writing, marked "A", dated the 22nd day of January, A.D. 1875, to be the true last will and testament of the said Robert S. Munn. That the said paper writing was found amongst the private papers of the Testator after his death.
- That I am the petitioner in the foregoing petition named, and that the several matters and things in the said petition set forth are correct and true to the best of this deponent's judgment, knowledge and belief.
