NEWFOUNDLAND
St. John's   To Wit          I Abraham Morgan of St. Johns aforesaid, Carpenter do swear that I believe that Abraham Morgan Sr. late of Coley's Point Conception Bay in the Northern District, Fisherman deceased, died with a Will; and that I will well and truly administer all and every the Goods of the said deceased and pay his debts, so far as his Goods will extend: and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased which he died possessed of, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of Six hundred and fifty dollars.

So help me God

Be it Remembered That on this 4th day of January in the 58th Year of the Reign of our Sovereign Lady Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of our Lord One Thousand Eight Hundred and ninety five personally appeared Abraham Morgan of St. Johns, Carpenter Thomas Dawe of St. Johns, Trader and William Richards of St. Johns Laborer and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal Sum of Thirteen hundred dollars to be had, made and levied on his Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following :---

Now the Condition of this Obligation is such, that if the above bounden Abraham Morgan as Administrator with the will annexed of the Estate and Effects of Abraham Morgan Sr late of Coley's Point, Conception Bay, Fisherman deceased, do make or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said Abraham Morgan as such Administrator or to the hands or possession of any other person, or persons, for him and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the 4th day of July next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of him the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of him the said Administrator or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the 4th day of January which will be in the Year of Our Lord One Thousand Eight Hundred and ninety six and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.

Halifax   To Wit          I John M. Withycombe of Weymouth in the province of Nova Scotia in the Dominion of Canada, Clerk in Holy orders make oath and say that on the 27th day of July A.D. one thousand eight hundred and eighty three at Coley's Point Conception Bay Newfoundland I was present and did see Abraham Morgan late of Coley's Point, aforesaid, Planter the Testator named in the paper writing hereunto annexed, marked A, duly sign (by making his mark) publish and declare the said annexed paper writing as and for his last Will and Testament, in my presence and in the presence of Henry Rouser? the other subscribing witness thereto. That I and said Henry Rouser then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other. That previously to the said Will being so signed, as aforesaid, by the said Testator and the said witnesses, it was read over to, and approved of by the said Testator in the presence of me and the said Henry Rouser and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

In the name of God Amen
          I Abraham Morgan of Coley's Point Conception Bay in the Island of Newfoundland Fisherman, being sound of mind and memory do on this Twenty seventh day of July, One thousand Eight hundred and eighty-three make this my last will and testament as follows :-
The piece of land extending from the stables? at the back of my house to the back fence shall be equally divided between my two sons Joseph and Abraham Morgan
My house with all belonging to me that it contains, also the store situated on the beach, and my pew in Coley's Point Church, I bequeath to my son Joseph Morgan and my pew in Bareneed Church I leave to my grandson Jacob Henry Morgan. The stage and wharf I leave for the use of each and all of my four sons Abraham, Isaac, Jacob and Joseph Morgan.
          That piece of land belonging to me at the head of Long Beach Pond on which the houses of my two sons Jacob & Isaac Morgan are built shall after my decease be divided between my two sons Jacob & Isaac Morgan

 

and shall become the property of them and their heirs but should they have no offspring the land shall after their deaths be passed to the next heir and not be sold to anyone out of my name or go out of the possession of my family. And that piece of land near Curle??s Road at the S.W. of Long Beach Pond measuring about four acres shall be divided between my four sons Abraham, Isaac, Jacob, and Joseph of which Joseph is to receive two acres and the remaining two acres to be divided between Abraham, Isaac, and Jacob.
          And I name as executors of my last will and testament Mr. Robert Parsons Sr. and Mr. Henry Rouser and charge them to see? the provisions fully carried into effect

The Petition of Abraham Morgan of St. Johns Carpenter -

Humbly Sheweth

          That your Petitioner's father Abraham Morgan Senior late of Coley's Point, Conception Bay, Fisherman died at that place about three years ago leaving his Widow Elizabeth Morgan and four sons viz: Abraham, Isaac, Jacob and Joseph and two daughters viz: Rebecca and Caroline -
          That the said deceased Abraham Morgan Senior left a will which is hereunto annexed marked A and which has been proven in due form of law on the

 

affidavit of John M. Withycombe Clerk in Holy Orders, being one of the subscribing witnesses thereto which said proof is here annexed marked B.
          That the Executors named in the said will viz: Robert Parsons Sr. and Henry Rouser are both dead.
          That the said deceased at the time of his death was possessed of land and property of the probable value of six hundred dollars.
          That the widow of said deceased viz. the said Elizabeth Morgan is over seventy eight years of age and very feeble, and has no interest in said will.
          That your Petitioners' sisters have no interest whatever under said will - and that his brothers have consented for him to take out Administration c.t.a.
          That no Probate or Administration has as yet been taken out to the said estate.
          Your Petitioner therefore prays that Administration cum testamento annexo of said deceased may be granted to him upon his giving the

 

security and as in duty bound he will ever pray -
