In the Supreme Court of Newfoundland

NEWFOUNDLAND
St. Johns   To Wit         I John E.P. Peters of St. John's in the Island of Newfoundland, Commission Merchant do swear that I believe this to be the true Last Will and Testament of Caroline Milley of St. Johns aforesaid, Married woman. I do further swear that I will pay all the Debts and Legacies of the said deceased so far as her Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Caroline Milley deceased, and of which she died possessed, do not, according to the best of my knowledge, judgment and belief, amount to the value of three thousand dollars

This is to certify that the notice on the other side hereof contained, has been duly posted in the office of the Chief Clerk of the Supreme Court of St. John's, from the day of the date thereof until this date, and that no caveat or other objection thereto has been filed or entered.

         The Petition of John E.P. Peters of Saint Johns, Commission Merchant

Humbly Sheweth

         That Caroline Milley of Saint Johns aforesaid died at Saint Johns on the 22nd day of March A.D. One thousand eight hundred and ninety five being possessed at the time of her death of property and estate within the jurisdiction of this Honourable Court of the probable value of under Three thousand dollars.
That hereunto annexed is the Last Will and Testament of the said deceased under which your petitioner has been appointed Executor.
That no application for Probate of the said will or for Administration to the said Estate has been previously made to this Honourable Court
         Your Petitioner therefore humbly prays that your Honourable Court or one of Your Lordships the Judges thereof will be pleased to grant unto him Probate of the said Last Will and Testament of the said Caroline Milley deceased.
         And as in duty bound Your Petitioner will ever pray

A

This is the Last Will and Testament of me Caroline Milley of Saint Johns Widow . I give and devise to my son Henry Milley the house No. 37 on Hayward Avenue at present in his possession and adjoining the dwelling house sold by me Thomas Butt.
I give and devise to my son Samuel Milley the house now in my occupancy situate on the side of Colonial Street.
I give and bequeath to each of my sons such sums as may stand in his name in the Savings Bank at the time of my death.
I give devise and bequeath unto my son Samuel Milley all the rest residue and remainder of my estate and effects and I appoint John E. P. Peters of Saint Johns Commissioner Merchant Executor of this my Will.
In Witness Whereof I hereby subscribe my hand at Saint Johns aforesaid this eighteenth day of July A.D. 1893 and declare the foregoing to be my Last Will and Testament.

To Wit         I William H Horwood of Saint Johns Solicitor make oath and say that on the eighteenth day of July A.D. one thousand eight hundred and ninety three at Saint Johns aforesaid I was present and did see Caroline Milley late of Saint Johns aforesaid the Testatrix named in the paper writing hereunto annexed duly sign publish and declare the said annexed paper writing marked A as and for her last Will and Testament, in the presence of me and of John Goss the other subscribing witness thereto. That I and said John Goss then and there signed our names to such Will as such witnesses, in the presence of the said Testatrix and of each other, and at the time of the said execution of the said Will the said Testatrix was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.
