NEWFOUNDLAND
St. Johns To Wit I Patrick Mahon of Torbay Farmer do swear that I believe this to be the true Last Will and Testament of Margaret Mahon of Torbay widow deceased. I do further swear that I will pay all the Debts and Legacies of the said deceased so far as her goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Margaret Mahon deceased, and of which she died possessed, do not, according to the best of my knowledge, judgment and belief, amount to the value of One hundred and ten dollars

The Petition of Patrick Mahon of Torbay, farmer,
Humbly Sheweth
- That Petitioner's mother, Margaret Mahon, late of Torbay, widow, deceased, died at that place in the month of April last past, having first made her last will and testament which is hereunto annexed, marked "A", proved upon the oath of James Whitty, one of the subscribing witnesses thereto.
- That under the said will your petitioner is sole executor.
- That the value of the estate of which deceased died possessed or entitled to does not exceed $100
- That neither Probate of the annexed will nor administration to the estate of the deceased has yet been granted to anyone.
Your Petitioner therefore prays that Probate of the annexed will may be granted to him as such executor.
And as in duty bound he will ever pray.

The last will and testament of Margaret Mahon of Torbay South? District of St. Johns East Newfoundland made this 29th day of March one thousand eight hundred and ninety five
I Margaret Mahon being very sick and indisposed in body ??? - but of perfect and sound mind and memory and of good understanding and calling to mind the finality and uncertainty of human life, that it is appointed once to die - Therefore I am desirous to settle my worldly affairs.
I do hereby will and bequeath to my son Patrick Mahon all the land adjunctive? to his house together with the medow? across the river where the old house formerly stood. Also my residual interest in that piece of land adjoining Patrick Ryans and Edward Cullen
Once knowne [sic] as James Co???'s - Further I do hereby will and bequeath that my son Patrick shall defray all my funeral expenses and just claims? and be sole executor hereof and that is all

St. John's To Wit I James Whitty of Torbay Farmer make oath and say that on the 29th day of March A.D. one thousand eight hundred and ninety five at Torbay I was present and did see Margaret Mahon late of Torbay widow the Testatrix named in the paper writing hereunto annexed duly sign (by making her mark) publish and declare the said annexed paper writing as and for her last Will and Testament, in my presence and in the presence of John Roche the other subscribing witness thereto. That I and said John Roche then and there signed our names to such Will as such witnesses, in the presence of the said Testatrix and of each other. That previously to the said Will being so signed, as aforesaid, by the said Testatrix and the said witnesses, it was read over to and approved of by the said Testatrix in the presence of me and the said John Roche and that at the time of the said execution of the said Will the said Testatrix was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.
