To the Honourable the Supreme Court of Newfoundland or One of the Honourable the Judges thereof.

The Petition of John Curran of St. Johns; Tailor and Clothier

Humbly Sheweth as follows

  1. That the late Charles Loughnan late of S. Johns in Newfoundland aforesaid Dealer, died at that place on or about the          day of November Anno Domini Eighteen hundred and ninety-four Intestate
  2. That, as by this Honorable Court directed, your Petitioner and others at various times have made a diligent and careful search and examination amongst the papers of the said deceased for any document, paper writing or other instrument purporting to be the last Will and Testament of the said deceased, and made a full investigation and inquiry to the ??? ??? ability? in this behalf but have failed to discover any such will.
  3. That the said deceased left him surviving ??? children, Charles at present residing at S. Johns aforesaid and Catherine Walsh Widow of the late John Walsh, now residing in the Convent at S. Ja???ce and known in Religion as Sister B???ia
  4. That the said Charles Loughnan




    son of said deceased is an invalid and at the present time in a critical condition of health and has been confined to his bedroom for some months past.
  5. That the said Catherine Walsh daughter of said deceased is also in a very delicate state of health and has been so for some years.
  6. That hereunto annexed is the consent in writing of the said children and next of kin of said deceased to the granting by this Honorable Court, Letters of Administration to the Estate of the said deceased to your Petitioner
  7. That at the time of his death the said deceased was possessed of property within the jurisdiction of this Honorable Court of the probable value of one hundred thousand dollars.
  8. That neither probate to any last will and testament or Letters of Administration to the estate and effects of the said deceased has yet been granted to any person
  9. Your petitioner would therefore ask your Honorable Court to grant him Letters of Administration to the Estate of ??? Charles Loughnan deceased and as in duty bound




    will ever pray &c &c &c

We, the undersigned solicitors for Charles Loughnan and Catherine Walsh respectively children and next of kin of the late Charles Loughnan late of S' Johns dealer, deceased, do hereby with the consent and approval of the said Charles Loughnan and Catherine Walsh consent to John Curran of S' Johns Tailor and Clothier being appointed by the Honorable the Supreme Court administrator of the estate and effects of the said Charles Loughnan deceased.

Be it Remembered That on this 11th day of March in the           Year of the Reign of our Sovereign Lady Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of our Lord One Thousand Eight Hundred and ninety five personally appeared John Curran of Saint John's, Tailor, The Right Rev. ??ctor? Howley Bishop of Saint Johns, John J. O'Reilly of Saint Johns ??? Dealer Edward Rawlins of Saint Johns Gentleman and Charles Loughnan of Saint Johns and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal Sum of One hundred and forty thousand dollars to be had, made and levied on his Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following :---

Now the Condition of this Obligation is such, that if the above bounden John Curran as Administrator of the Estate and Effects of Charles Loughnan late of Saint Johns Gentleman deceased, do make or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said John Curran as such Administrator or to the hands or possession of any other person, or persons, for him and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the 11th day of September next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of him the said John Curran or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the 11th day of March which will be in the Year of Our Lord One Thousand Eight Hundred and ninety six and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.

NEWFOUNDLAND St. John's
          To Wit          I do swear that I believe that Charles Loughnan late of St. Johns Gentleman deceased, died without a Will; and that I will well and truly administer all and every the Goods of the said deceased and pay his debts, so far as his Goods will extend and the law shall bind me; and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased which he died possessed of, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of Seventy Thousand dollars.
