NEWFOUNDLAND
Channel   To Wit          I John LeMoine of Channel Tidewaiter do swear that I believe that Alexander W. LeMoine late of Channel in the Southern District Lobster packer deceased, died without a Will; and that I will well and truly administer all and every the Goods of the said deceased and pay his debts, so far as his Goods will extend: and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased which he died possessed of, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of One thousand two hundred dollars.

Be it Remembered That on this Twelfth day of February in the          Year of the Reign of our Sovereign Lady Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of our Lord One Thousand Eight Hundred and ninety five personally appeared John Le Moine of Channel in the Southern District, ??? ??? and Nathan Smith and James W. Keating also of Channel aforesaid, Gentleman and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal Sum of Two thousand four hundred dollars to be had, made and levied on his Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following :---

Now the Condition of this Obligation is such, that if the above bounden John LeMoine as Administrator of the Estate and Effects of Alexander W. Le Moine late of Channel aforesaid Lobster Packer deceased, do make or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said John Le Moine as such Administrator or to the hands or possession of any other person, or persons, for him and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the Twelfth day of August next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of him the said John Le Moine or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the Twelfth day of February which will be in the Year of Our Lord One Thousand Eight Hundred and ninety six and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.

Three days from the date hereof application will be made to the Supreme Court or one of the Honourable the Judges thereof for Letters of Administration to the Estate of Alexander W. LeMoine late of Channel Lobster Packer deceased to be granted to John Le Moine of Channel aforesaid Deputy Sheriff father of deceased.

To the Honourable the Supreme Court or one of the Honourable Judges thereof

The petition of John LeMoine of Channel in the District of Burgeo and LaPoile Tidewaiter

Humbly Sheweth

That your petitioner's youngest son Alexander W LeMoine late of Channel aforesaid Lobster Packer accompanied by his wife Maria LeMoine left Channel aforesaid on the night of Thursday the twenty-second day of November last-past in the schooner Maud Gillam of Channel aforesaid, Michael Gillam Master, bound for the port of North Sydney in Cape Breton.
That the said schooner Maud Gillam has never arrived at her destination neither has any account of her fate nor of the fate of the persons on board ever been ascertained.
That the said schooner Maud Gillam has now been given up as lost with all on board.
That the said Alexander W LeMoine died without having made a will leaving him surviving four children viz: Florence Maria aged six years, John Charles aged four years, Muriel Marcella aged two-and-one-half years, Francis Thomas Clifford aged fifteen months.
That the life of the said Alexander W LeMoine was insured in the Mutual Life Insurance Company of New York

 

York in the sum of one thousand dollars payable to Alexander W LeMoine his Executors Administrators or Assigns, and at the time of his decease the estate of the said Alexander W LeMoine within the Jurisdiction of your Honourable Court, did not exceed the sum of One thousand dollars in Value - And also that with the exception of the aforesaid Policy of Insurance the said Alexander W LeMoine was possessed of no other property whatever
That at the time of his decease the said Alexander W LeMoine and his family resided with your petitioner and that at the present time your petitioner has charge of the aforesaid four children of the said Alexander W. LeMoine.
That no letters of Administration of the said Alexander W LeMoine's Estate have been granted.
          Your Petitioner humbly prays that letters of Administration of said Estate and and the Guardianship of said children be granted to him and as in duty bound will ever pray
          The third day of January A.D. 1895.
