NEWFOUNDLAND
St. Johns   To Wit          I Catherine Kough do swear that I believe this to be the true Last Will and Testament of Thomas Kough late of Saint Johns in the Central District, one of her Majesty's Counsel. I do further swear that I will pay all the Debts and Legacies of the said deceased so far as his Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased, and of which he died possessed, do not, according to the best of my knowledge, judgment and belief, amount to the value of Ten thousand five hundred dollars

So help me God

To the Honorable the Supreme Court of Newfoundland or to one of the Honorable the Judges thereof.

The Petition of Catherine Kough of St. Johns Spinster

Humbly Sheweth

That Thomas J. Kough of St. Johns aforesaid one of Her Majesty's Counsel died at St. Johns on or about the 29th of May last past having previously made his last will and testament.
That the paper writing hereto annexed marked A and identified by the initials "H.H.C." is the said last will and testament and is entirely in the handwriting of the said Thomas J. Kough and is proven upon the affidavit (hereunto annexed) of Hugh Hoyles Carter Barrister-at-Law.
That under the said last will and testament your petitioner was appointed sole Executrix of the same
That at the time of his death the said Thomas J. Kough was possessed of property in the Jurisdiction of the Court of the probable value of Ten thousand dollars.
That the said Thomas J. Kough left him surviving one brother and five sisters of whom your petitioner is one.
That no probate of the will or administration of the Estate of the said Thomas J. Kough has been granted by this Honorable Court.
          Your petitioner therefore prays that Probate of the said last will and testament may be granted to her and as in duty bound she will ever pray &c &c

I Thomas J. Kough of St. Johns Newfoundland Q.C. do make and publish this my last will and testament (Holograph) I give devise and bequeath unto my sisters Margaret Kough, Catherine Kough, Anne Kough and Harriet Kough all my undivided share and interest in and to all lands tenements bank stock and moneys on deposit receipts and all other chattels which I have acquired out of and from the Estate of my father, the late Honorable Patrick Kough to the absolute use and behalf? of my above named sisters. With respect to my own property I give devise and bequeath to my sisters Margaret Kough Catherine Kough and Anne Kough the land purchased by me from the late Sir Hugh W. Hoyles (executor) situate at Cochran Place Military Road and the House thereon recently erected by me. To have and to hold the same with their appurtenances

 

unto the said Margaret Kough, Catherine Kough and Anne Kough for the term of their natural lives and to the survivors or survivor of them, and at the decease of such survivor I will and direct and hereby devise and bequeath the said lands house and tenements at Cochran Place aforesaid unto my brother Patrick Kough, to hold to have in perpetuity. I bequeath my gold watch to my brother Patrick Kough. I bequeath to my sister Catherine Kough all the chattels and other property bank stock household furniture moneys and generally the residuary estate left by me.
I nominate and appoint my said sister Catherine Kough sole executrix of this my last will and testament.
Dated at St. Johns aforesaid this twenty sixth day of January anno domini one thousand eight-hundred and ninety-four.

I Hugh Hoyles Carter of St. Johns aforesaid Barrister at Law make oath and say as follows:
I was well acquainted with the late Thomas J. Kough of St. Johns aforesaid one of her Majesty's Counsel and with his handwriting for the past twenty years
The paper writing hereto annexed marked "A" and identified by my initials "H.H.C." is entirely in the handwriting of the said Thomas J. Kough

I verily believe that the said Thomas J. Kough on the 26th day of January One thousand Eight hundred and ninety four the date on which the said paper writing or holograph will purports to be signed was of sound and disposing mind memory and understanding

The Memorial of Thomas J. Kough of Saint Johns in the Central District of Newfoundland, Barrister at Law,

Respectfully sheweth

That Patrick Kough late of Saint Johns aforesaid Architect, Memorialist? father? departed this life on or about the ninth day of November last past, having previously made and published his last will and testament hereto annexed, appointing Mary Kough - widow of the said Patrick Kough, and your Memorialist? Executors of the same.
That the said Patrick Kough left him surviving his widow above named - Two sons Thomas? Kough (Memorialist and Patrick Kough, ???

 

and six daughters, Margaret Kough, Elizabeth Kough, Catherine Kough, Anne Kough, Harriet Kough and Frances Kough
That the said Patrick Kough - deceased, was at the time of his death possessed of real and personal property moneys and other chattels of the probable value of six thousand pounds sterling.
Memorialist? therefore respectively requests that Probate of the said Will may be granted to the said Mary Kough and to Memorialist - the executors named in the Will, and as in duty bound &c :-
