The Petition of Edward Kitchin of Harbor Grace in the Northern District of the Island of Newfoundland

Humbly Sheweth

That your Petitioner's mother, the late Susannah Kitchin late of Harbor Grace aforesaid widow died at that place on the eighth day of May in the year of our Lord One thousand eight hundred and ninety five intestate.
That the said late Susannah Kitchin left surviving her as next of kin seven children; viz; John George, Jesse, Anna, Emmanuel? Caroline, Elizabeth and your Petitioner.
That at the time of the death of the said late Susannah Kitchin she was possessed of property situate at Harbor Grace aforesaid of the probable value of Two hundred Dollars
That no Probate or administration to the said Estate has hitherto been granted by this Hon. Court.
That hereunto attached is a consent in writing signed by all of the aforesaid parties except Jesse Kitchin who is at present in Halifax preparing?

my? petition to take out Letters of Administration to the Estate of the said Susannah Kitchin.
          Your petitioner therefore prays that Letters of Administration to the said Estate may be granted to him
          And as in duty bound will ever pray &c

Be it Remembered That on this 6^th day of November in the 59^th Year of the Reign of our Sovereign Lady Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of our Lord One Thousand Eight Hundred and ninety five personally appeared Edward Kitchin of Harbor Grace in the Northern District Laborer Jeremiah Martin same place Sailmaker and Paul Higgins of same place Hair dresser and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal Sum of Four hundred dollars to be had, made and levied on his Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following :---

Now the Condition of this Obligation is such, that if the above bounden Edward Kitchin as Administrator of the Estate and Effects of Susannah Kitchin late of Harbor Grace aforesaid Widow deceased, do make or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said Edward Kitchin as such Administrator or to the hands or possession of any other person, or persons, for him and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the 6^th day of May next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of him the said Administrator or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the 6^th day of November which will be in the Year of Our Lord One Thousand Eight Hundred and ninety six and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.

To Wit          I do swear that Susannah Kitchin late of Harbor Grace aforesaid Widow deceased died without a Will: and that I will well and truly administer all and every the Goods of the said deceased and pay her Debts so far as her Goods will extend and the law shall bind me and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased and render a true account of my Administration into the Registry of the said Court within Six months after the date hereof, or when I shall be thereunto lawfully required; and that the whole of the goods, rights, chattels, assets, credits and effects of the said deceased, of which she died possessed, within the jurisdiction of this Court do not, according to the best of my knowledge, judgment and belief, amount to the value of two hundred dollars.

Here is a daughter of George KITCHEN and Susan KITCHEN  nee WEBBER.

As per the above will

That the said late Susannah Kitchin left surviving her as next of kin seven children; viz; John George, Jesse, Anna, Emmanuel? Caroline, Elizabeth and your Petitioner.

I can confirm from my research

John Cowan Kitchen = John
George William Kitchen  = George
Jessica Kitchen = Jesse
Ann Hamutal = Anna, Emmanuel?
Caroline Amelia = Caroline
Elizabeth = Elizabeth
Edward Newton Kitchen = Edward the petitioning son in the above will.

Ann Hamutal KITCHEN married William ADAMS. So in the transcription of the signatories, Hamulal? Adams is the daughter Ann Hamutal.

In the 1921 census for Harbour Grace Eastside, the census taker was most definitely handicapped with numbers as the DOBs for William and wife were off by at least a decade. NB that wife Hamutal written as Amutal has been transcribed as Annabal.

In the 1935 census the name is transcribed correctly much to the surprise of the transcriber who thought the name was not correct.
