NEWFOUNDLAND
Channel   To Wit          I George Poole Burnt Islands in the Southern District Fisherman do swear that I believe that Susan Kerley late of Burnt Islands aforesaid Widow deceased, died with a Will; and that I will well and truly administer all and every the Goods of the said deceased and pay her debts, so far as her Goods will extend: and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased which she died possessed of, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of seventeen hundred dollars.

Be it Remembered That on this Seventeenth day of May in the 58th Year of the Reign of our Sovereign Lady Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of our Lord One Thousand Eight Hundred and ninety five personally appeared George Poole of Burnt Island in the Southern District fisherman, John Gillam Master Mariner and Austin Martin Blacksmith ??? Channel in said District and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal Sum of three thousand four hundred Dollars to be had, made and levied on her Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following :---

Now the Condition of this Obligation is such, that if the above bounden George Poole as Administrator cum testamento annexo of the Estate and Effects of Susan Kerley late of Burnt Island aforesaid Widow deceased, do make or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said George Poole as such Administrator or to the hands or possession of any other person, or persons, for him and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the 17th day of November next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of her death, or which at any time afterwards shall come into the hands or possession of him the said Administrator or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the 17th day of May which will be in the Year of Our Lord One Thousand Eight Hundred and ninety six and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.

Notice

After three days from date hereof application will be made to the Supreme Court or one of the Honorable the Judges thereof for Letters of Administration C.T.A. to the will of Susan Kerley late of Burnt Island Widow deceased to be granted to George Poole of Burnt Island fisherman the sole legatee named in the said Will.

To the Supreme Court of Newfoundland or one of the Honourable Judges thereof:

The Petition of George Poole in Burnt Island, in the District of Burgeo and LaPoile, Fisherman

Humbly sheweth

          That your petitioners sister Susan Kerley late of Burnt Island aforesaid Widow, died on the thirty first day of March A.D. 1894, at Burnt Island aforesaid having previously made her last Will and Testament which is hereto annexed and marked "A".
          That no Executors are appointed by said Will.
          That your petitioner is the legatee named in the said Will
          That the signature "George Poole" as one of the Witnesses to said Will is the Signature of your Petitioner and that he is one of the Witnesses to said Will.
          That Thomas Kerley the late husband of the said Susan Kerley died at Burnt Island aforesaid about twenty-seven years ago.
          That the said Susan Kerley left no children surviving her.
          That besides your petitioner the said Susan Kerley left her surviving one brother Emmanuel Poole aged about fifty years, and four sisters :- Catherine Framp, Widow, aged about seventy years, Magdalen Hill aged about sixty-eight years, Mary Ann Johnston, Widow, aged about

 

sixty-six years and Bethana Keeping aged about sixty-four years.
          That there are relatives of Thomas Kerley aforesaid residing in Fortune Bay but that your petitioner is unacquainted with them.
          That at the time of her decease the Estate of the said Susan Kerley within the jurisdiction of your Honorable Court did not exceed the sum of sixteen hundred dollars in value.
          That no letters of Administration of said Estate have been granted.
          Your petitioner humbly prays, therefore, that letters of Administration of said estate with the Will annexed be granted to him and as in duty bound he will ever pray.
          The Nineteenth day of April A.D.  1894.

          The last will and bequest of Susan Caerley widow of Thomas Caerley of Burnt Islands in the District of Burgeo and La Poile
I Susan Caerley do bequeath and will to George Poole of Burnt Islands, my brother, and to his heirs and successors for ever all my property at Burnt Islands, namely my dwelling house with all furniture & house hold goods in the same; three stores situate, two on the south and one on the east side of my house, together with all the land pertaining thereto both north south east and west of my dwelling.
Moreover in addition to

this my last will and testament I Susan Caerley do bequeath and will to the above George Poole, my brother, and to his heirs and successors for ever my personal wealth to the amount of ten hundred & eighty dollars ($1080.00) deposited in the Union Bank of Newfoundland with the interest there upon, of the said deposit No. 19279 dated 10th November in the years of ??? 1891.
Also any money which may be in the house or which may be due to me on and at the time of my death I bequeath to my brother George Poole of Burnt Islands.
Given under my hand this 11th day of June in the year of our Lord 1892.

I Augustus G (A.G.B.) Bayly of St. Johns Clerk in Holy Orders do make oath and say that on the Eleventh day of June A.D. one thousand eight hundred and ninety-two at Burnt Islands I was present and did see Susan Caerley late of Burnt Islands Widow the Testatrix named in the paper writing hereunto annexed duly sign (by making her mark) publish and declare the said annexed paper writing as and for her last Will and Testament, in the presence of George Poole of Burnt Island aforesaid, the other subscribing witness thereto. That I and said George Poole then and there signed their names to such Will as such witnesses, in the presence of the said Testatrix and of each other. That previously to the said Will being so signed, as aforesaid, by the said Testatrix and the said witnesses, it was read over to, and approved of by, the said Testatrix in the presence of me and the said George Poole and that at the time of the said execution of the said Will the said Testatrix was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.
