NEWFOUNDLAND
St. Johns     To Wit          I Edward Kennedy of Long Pond Conception Bay Farmer do swear that I believe that Jacob Kennedy late of Long Pond farmer deceased died without a Will: and that I will well and truly administer all and every the Goods of the said deceased and pay his Debts so far as his Goods will extend and the law shall bind me and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased and render a true account of my Administration into the Registry of the said Court within Six months after the date hereof, or when I shall be thereunto lawfully required; and that the whole of the goods, rights, chattels, assets, credits and effects of the said deceased, of which he died possessed, within the jurisdiction of this Court do not, according to the best of my knowledge, judgment and belief, amount to the value of two hundred and twenty dollars.

Cum testament annexo to the Estate of the late Jacob Kennedy late of Long Pond Farmer deceased, to be granted to Edward Kennedy son of said deceased and ??? under said will.

Kelligrews     To Wit
I John James Dawe of Long Pond in the Central District Fisherman make oath and say that on the 11th day of September A.D. one thousand eight hundred and ninety four at Long Pond I was present and did see Jacob Kennedy late of Kelligrews the Testator named in the paper writing hereunto annexed, Marked A, duly sign (by making his mark) publish and declare the said annexed paper writing as and for his last Will and Testament, in my presence and in the presence of Francis F. Furneaux the other subscribing witness thereto. That I and said Francis F. Furneaux then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other. That previously to the said Will being so signed, as aforesaid, by the said Testator and the said witnesses, it was read over to and approved of by the said Testator in the presence of me and the said Francis F. Furneaux and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.

          In the Name of God Amen
          I Jacob Kennedy of Long Pond, South Shore, Conception Bay, in the Island of Newfoundland Fisherman and Farmer, being very sick and weak in body but of perfect mind and memory do make and ordain this my last will and testament.
          First I give and bequeath to my son Edward that piece of cultivated marsh land north of the Main Road in Long Pond and bounded as follows, North by Bernard Jean's land, South by land I gave my son Thomas, East by land owned by John and Richard Kennedy and West by Bernard Jeans land.
          Second I give to my son Edward that piece or parcel of land situate on Long Pond south of the ??? Road, bounded as follows, south by the Railroad, North by land I intend giving my grandson William Thomas of Robert East by Sarah Bishop's (widow) land and West by Charley Porter's land.
          Third I give to my grandson William Thomas Kennedy of Robert my dwelling house goods and chattels, stable, cellar, cattle, and all loose gear together with the cultivated land surrounding the said dwelling house. Bounded as follows North by Main Road South by land I have given my son Edward west by Charley Porter and East by widow Sarah Bishop's land.
          Fourth I give to William Thomas Kennedy my grandson of Robert that piece or parcel of land situate in Long Pond north of Main Road and bounded as follows, West by Bernard Jean's land, East by Joseph and Richard Kennedy's land, North by the water of Conception Bay and South by Tobias Porter
          Fifth my land inside the railroad is to be divided into two equal shares between my son Edward and William Thomas Kennedy my grandsons except and apart from the piece of land I gave Thomas Kennedy my son

 

deceased, The said land is bounded as follows, north by the Railroad, South by land owned by the late R??? Pillard? East by land I gave my son Thomas and West by Charly Porter's land
          Sixth I give to my son Edward the land that his dwelling house & stable are on
          Seventh I give to my grandson Jacob Kennedy my ford? my feather bed & bedding
          Eighth, the beach at the waterside is to be divided into two equal parts between my son Edward and my grandson William Thomas Kennedy of Rob't I give them my gra???ls. I give my two guns to my son Edward. The horse cart shall be sold to pay for ??? ???
          Ninth. It is my desire and wish that my son Edward shall have charge of all the property that I have given and bequeathed to William Thomas Kennedy my grandson until he becomes of age to take charge of all himself. My daughter-in-law Fanny wife of my son Robert is to live on the said property and be supported out of the produc??? while she remains in the name of the widow of the late Robert Kennedy. If she should marry again, she cannot bring her husband to live on the place.
          Tenth, if my grandson William Thomas Kennedy died before he became of age, his sister Mary M??? is to take possession of the property when she comes of age and it is my desire and wish that if she lives here in Long Pond to be maintained by the property and I have given and bequeathed to my grandson William Thomas until she has a house of her own. And I do hereby utterly disallow revoke, and disannul all and every other former Testaments Will, and Bequests, except the property I gave as a Deed of Gift to my son Thomas Kennedy, the Deed having been executed on the first day of March A.D. 1894) by Will? any wise? before named willed and bequeathed ratifying and confirming this

 

and no other to be my last Will and Testament. In witness whereof I have hereunto set my hand and seal this 11th day of September in the year of our Lord One Thousand eight Hundred and Ninety five. I hereby hold? this proven to the above that if my grand Son William Thomas Kennedy and my grandaughter Mary Matilda died before they became of age and my daughter-in-law Fanny Kennedy was provided? for. My son Edward is to become sole possessor of which I have given to my grandson William Thomas Kennedy.

The Petition of Edward Kennedy of Long Pond South Shore Conception Bay Newfoundland, Farmer

Humbly Sheweth as follows

          That Jacob Kennedy late of Long Pond South Shore Conception Bay, farmer deceased died at that place on the 17th day of September AD 1894.
          That previous to his death said deceased made and executed his last will and testament which is hereunto annexed proven upon the affidavit of John James Dawe one of the subscribing witnesses thereto.
          That said deceased neglected to appoint an executor to his said Will and Testament.
          That your Petitioner is the only surviving son of the said Jacob Kennedy on the p???fal? ??? under the said last Will and Testament.
          That at the time of his death the said deceased was possessed of property within the jurisdiction

 

of this Honorable Court of the probable value of two hundred dollars.
          That neither Probate to any last will, nor Letters of Administration to the said Estate has yet been granted to any person.
          Your Petitioner ??? therefore ??? that your Honorable Court would grant him Letters of Administration Cum testamento annexo to said Estate and as in duty bound will ever pray. &c &c &c

Be it Remembered That on this 14th day of September in the 59th Year of the Reign of our Sovereign Lady Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of our Lord One Thousand Eight Hundred and ninety five personally appeared Edward Kennedy of Long Pond Conception Bay, Farmer, Edward Kennedy of Long Pond, Farmer, and Robert Rideout of Long Pond Farmer and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal Sum of four hundred and forty Dollars to be had, made and levied on his Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following :---

Now the Condition of this Obligation is such, that if the above bounden Edward Kennedy as Administrator with the will annexed of the Estate and Effects of Jacob Kennedy late of Long Pond, aforesaid Farmer deceased, do make or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said Edward Kennedy as such Administrator or to the hands or possession of any other person, or persons, for him and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the 14th day of March next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of him the said Administrator or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the 14th day of September which will be in the Year of Our Lord One Thousand Eight Hundred and ninety six and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.
