Harbor Main To Wit  }

We do swear that we believe this to be the true Last Will and Testament of James Keefe late of Conception Harbor in the Southern District of the Island of Newfoundland fisherman deceased. We do further swear that we will pay all the Debts and Legacies of the Deceased, so far as his Goods shall extend and the Law shall bind us: and that we will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And we do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said James Keefe deceased, and of which he died possessed, do not according to the best of our knowledge, judgment and belief, amount to the value of two hundred dollars

     Three days from the date hereof application will be made to the Honourable the Supreme Court or one of the Honourable the Judges thereof for Letters of Probate to the last Will and Testament of James Keefe late of Conception Harbor in Conception Bay Newfoundland fisherman deceased to be granted to Richard Donovan and Mary Joseph Donovan the Executors and Executrix in the said Will named and appointed

The Petition of Richard Donovan and Mary Joseph Donovan of Conception Harbor, C Bay

Humbly Sheweth

          That James Keefe late of Conception Harbor fisherman deceased died at the above place on or about the 6th day of March AD 1895

          That previous to his death said deceased made and executed his last Will and Testament which is hereunto annexed proven upon the affidavit of Patrick St. John one of the subscribing witnesses thereto.

          That in and by the said last will & Testament said deceased nominated and appointed your Petitioner and his wife Mary Joseph Donovan Executor and Executrix thereof.

          That at the time of his death the said deceased was possessed of property within the Jurisdiction of this Honourable Court of the probable value of Two hundred dollars.

 

          That neither Probate to any last will nor Letters of Administration to the Estate of said deceased has yet been granted to any person.

          Your Petitioners therefore pray that your Honourable Court may grant them Probate to the said last Will and testament and as in duty bound will ever pray

St. John's To Wit        } I Patrick St. John of Conception Harbor C. Bay make oath and say that on the 4th day of March A.D. one thousand eight hundred and ninety five at Conception Harbor I was present and did see James Keefe late of Conception Harbor the Testator named in the paper writing hereunto annexed, marked A, duly sign (by making his mark) publish and declare the said annexed paper writing as and for his last Will and Testament, in my presence and in the presence of Edward S. John the other subscribing witness thereto. That I and said Edward S. John then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other. That previously to the said Will being so signed, as aforesaid, by the said Testator and the said witnesses, it was read over to, and approved of by the said Testator, in the presence of me and the said Edward S. John and at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

          In the name of God, Amen. I James Keefe of Conception Harbor, Planter, being of sound mind, memory and recollection do make and ordain this my last Will and Testament and do dispose of all my effects in the manner and form following.
First, I give and bequeath to my son-in-law Richard Donovan all that piece of land bounded on the North by Big Pond Road, on the South and West by land owned by Edward St. John and on the East by the old Main Road.
Secondly I give and bequeath my bed and bedding to my grand son Patrick Donovan.
Thirdly I give and bequeath all the rest of my Estate consisting of Dwelling house, Stable, Cattle and out-houses &c to my daughter Mary Joseph Donovan.
And I hereby revoke all other testamentary writings by me made and do appoint the said Richard Donovan and Mary Joseph Donovan to be the Executor and Executrix of my last Will and Testament, in witness whereof I have hereunto set my hand this the 4th day of March A.D. 1895.
