Notice

Three days from the date hereof Application will be made to the Honourable the Supreme Court or to one of the Honourable the Judges thereof for Probate of the will of Harriet Johnston late of Saint Johns married woman deceased to be granted to James R. Johnston the Executor named therein.

I hereby certify that the notice on the other side hereof has been posted up in the office of the Chief Clerk and Registrar on and since the 26th day of November instant and that no Caveat or other objection has been entered thereto.

The Petition of James R. Johnston of Saint Johns Carpenter

Humbly Sheweth

That your Petitioner's wife Harriet Johnston died at that place on the twentieth day of November instant having first made her last Will and Testament which is hereto annexed.

That the said Harriet Johnston by her said last Will and Testament appointed your Petitioner the sole Executor thereof.

That the Estate and effects of the said late Harriet Johnston are of the probable value of about three thousand dollars.

That no Letters of Probate of the said Will or Administration to the said Estate have been at any time granted.

Your Petitioner therefore prays that Letters of Probate of the said annexed last will and Testament may be granted to him.

And as in duty bound Your Petitioner will ever pray &c &c.

Dated at Saint Johns this 30th day of November AD 1895

This is the last Will and Testament of me Harriett Johnston of Saint Johns in the Island of Newfoundland Married Woman

I give devise and bequeath unto my husband James R. Johnston all my right title and interest in and to that piece or parcel of leasehold property with Dwelling Houses and other erections thereon and occupied by me situate on the East side of Belvidere Street in the town of Saint Johns aforesaid; Also that piece of leasehold property with Dwelling House thereon Situate on the East side of Belvidere Street and occupied by tenants. Also a piece of leasehold land with shed thereon situate on Prescott Street and held fo?? W & G Rendell Agents and also all properties of every description of which I may die possessed
IN TRUST to manage my Estate generally and sell and dispose of the same should he think necessary and invest the proceeds thereof at his discretion for the benefit of my children Frederick, Bessie Janet, Ellen Daisy and Blanche to be equally divided amongst them when the youngest shall attain the age of twenty one years. And I hereby appoint my said husband James R. Johnston the Executor of this my last Will and Testament.

To Wit          }  I Charles H. Emerson of Saint Johns Solicitor make oath and say that on the third day of July A.D. one thousand eight hundred and ninety five at Saint Johns I was present and did see Harriet Johnston late of Saint Johns married woman the Testatrix named in the paper writing hereunto annexed duly sign publish and declare the said annexed paper writing as and for her last Will and Testament, in the presence of me and of Marmaduke W? Clow? the other subscribing witness thereto. That I and said Marmaduke W? Clow? then and there signed their names to such Will as such witnesses, in the presence of the said Testator and of each other and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

St. Johns To Wit         } I James R. Johnston of St. Johns Carpenter, do swear that I believe this to be the true Last Will and Testament of Harriet Johnston late of S' Johns, Married woman deceased.

I do further swear that I will pay all the Debts and Legacies of the said deceased so far as her Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Harriet Johnston deceased, and of which she died possessed, do not, according to the best of my knowledge, judgment and belief, amount to the value of three thousand five hundred dollars
