Newfoundland
Saint Johns To Wit          I do swear that I believe this to be the true Last Will and Testament of Johanna Howley late of Saint John's in the Central District Widow I do further swear that I will pay all the Debts and Legacies of the said deceased so far as her Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Johanna Howley deceased, and of which she died possessed, do not, according to the best of my knowledge, judgment and belief, amount to the value of Eight thousand five hundred dollars

The petition of the Right Reverend Doctor Michael Francis Howley Roman Catholic Bishop of St. Johns

Humbly Sheweth

  1. That Johanna Howley late of St. Johns Widow of the late Alexander Howley died at St. Johns aforesaid on or about the 4th day of September A.D. 1895 having duly made and Executed his last will and Testament.
  2. That at the time of her death the said Johanna Howley was possessed of property within the jurisdiction of this honorable Court to the probable value of $8500.
  3. That she the said Johanna Howley left her surviving two sons, namely Edward St. John Howley of New York in the United States of America and Alexander R. Howley of St. Johns aforesaid.
  4. That your petitioner is the sole Executor in the said will named and that probate has not heretofore been granted to any one

          Your petitioner therefore prays that probate of the said last will and testament of the said Johanna Howley may be granted to him as such Executor and as in duty bound he will ever pray &c &c &c

Mrs Johanna Howley
3 Sept 1895

I Hannah St. John Howley of St. John's Newfoundland Widow of the late Alexander Howley of St. Johns aforesaid being of sound and disposing mind tho weak in bodily health do hereby declare this to be my last will and testament to wit, after all my lawful debts and funeral and other expenses all have been paid; I bequeath to my eldest? son Edward Howley now in New York, the farm on the Torbay Road, in the Vicinity of St. Johns aforesaid, and known by the name of "Lakefield" together? with all ??? utensils? and appur

 

tenances being upon or belonging thereto
I also bequeath to the said ??? St. J. Howley the Script? of the Harbor Grace Water Company's stock for ??? 500..0..0 [sic] by bearing interest at 4% per annum
I bequeath to my younger son Alexander R. Howley the remaining portion of my property namely. One Government debenture of the Value of four thousand dollars bearing interest at five? percent per annum and one Government Debenture of the Value of one thousand seven hundred and ninety dollars and sixty Cents bearing interest at five percent per annum.
I appoint as my sole executor the Right Rev Michael F Howley Bishop of St. Johns Newfoundland

After three days application will be made to the Supreme Court or one of the Honorable the Judges thereof that Probate of the will of the late Johanna Howley of St. Johns widow be granted to the Right Reverend M. F. Howley Bishop of St. Johns the Executor in the said will named

I Nutting [sic] S. Fra?? of St. Johns Doctor of Medicine make oath and say that on the third day of September A.D. one thousand eight hundred and ninety five at          I was present and did see Johanna Howley late of St Johns aforesaid Widow the Testatrix named in the paper writing hereunto annexed duly sign publish and declare the said annexed paper writing marked A as and for her last Will and Testament, in the presence of me and of John St. John the other subscribing witness thereto. That I and said John St. John then signed our names to such Will as such witnesses, in the presence of the said Testatrix and of each other, and at the time of the said execution of the said Will the said Testatrix was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.
