The Petition of F.J. Morris of St. Johns Barrister at Law
Humbly Sheweth
That John Hearn late of St. Johns Farmer deceased died at that place in or about the month of October Anno Domini Eighteen hundred and Eighty Seven
That previous to his death the said deceased made and executed his last will and testament which is hereto annexed proven upon the oath of John J Hennessey? Barrister at Law one of the subscribing witnesses thereto.
That in and by said last Will and Testament said deceased appointed your Petitioner as Executor hereof.
That at the time of his death said deceased was possessed of property within the jurisdiction of this Honourable Court of the probable value of one thousand dollars.
That neither Probate
to any last will nor Letters of Administration to Said Estate has as yet been granted to any person.
Petitioner therefore prays that your Honourable Court may grant him Letters of Probate to Said last will and Testament and as in duty bound he will ever pray &c

This is the last will and Testament of me John Hearn of St. John's in the Island of Newfoundland Fisherman First I devise and bequeath to my wife Mary Hearn all my property of whatsoever description I may die possessed of for her sole use support and maintenance the said property consisting of all that farm of land [sic]
with dwelling house thereon situate South side Waterford Bridge Valley bounded on the East by land of Philip St. John West by land of John Symes south by ungranted land North by the Public road and measuring about three acres also all that piece of land situate south side of said valley and bounded on the North by the said Public Road on the South and West by land of Joseph Cahill and East by land of Said John Syme and measuring about two acres also a small piece of land opposite my dwelling house aforesaid and measuring about three fourths of an acre.
I hereby appoint F.J. Morris of St. Johns attorney and Solicitor Sole Executor of this my last will and testament.
In Witness whereof I have hereunto my [sic] hand subscribed and set at St. Johns aforesaid this twenty second? day of September AD 1887

To Wit }
John J. Flannery Barrister at Law of St. John's maketh oath and saith that on the 22nd day of September A.D. one thousand eight hundred and Eighty seven at St. John's he, this Deponent, was present and did see John Hearn late of St. Johns farmer the Testator named in the paper writing hereunto annexed duly sign publish and declare the said annexed paper writing as and for his last Will and Testament, in the presence of this Deponent and of F. J. Morris of St. John's aforesaid Barrister at Law the other subscribing witness thereto. That Deponent and said F. J. Morris then and there signed their names to such Will as such witnesses, in the presence of the said Testator and of each other, and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

To Wit I Frank J. Morris of St. John's in the Central District Solicitor, do swear that I believe this to be the true Last Will and Testament of John Hearn late of St. John's aforesaid Farmer deceased. I do further swear that I will pay all the Debts and Legacies of the said deceased so far as his Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said John Hearn, deceased, and of which he died possessed, do not, according to the best of my knowledge, judgment and belief, amount to the value of one thousand two hundred dollars
