St. Johns To Wit } I William E. Wood of St. John's in the Central District of Newfoundland Solicitor do swear that I believe this to be the true Last Will and Testament of Eliza Francis late of Waterford, Ireland, Widow deceased. I do further swear that I will pay all the Debts and Legacies of the said deceased so far as her Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Eliza Francis deceased, and of which she died possessed, do not, according to the best of my knowledge, judgment and belief, amount to the value of Nine thousand five hundred dollars

The petition of William E. Wood of Saint Johns Solicitor
Humbly Sheweth
- That Eliza Francis late of Saint Johns aforesaid Widow deceased died at Waterford, Ireland on or about the 16th day of November A.D. 1894 having previously made and executed her last Will and Testament which with the affidavit in proof thereof is hereto annexed marked A
- That your petitioner is sole executor under said Will.
- That the said deceased at the time of her death was possessed of property of the probable value of $ 9000.00
- That petitioner has caused to be posted in the office of the Chief Clerk and Registrar of this Honorable Court the notice hereto annexed marked B for the period mentioned in the certificate thereon entered and that no caveat or other objection has been entered thereto.
- That no probate of any will or administration to the Estate of said deceased has been granted to any person
Petitioner therefore prays that probate of the said Will may be granted to him.
And as in duty bound he will ever pray &c

This is the last will and testament of me Eliza Francis of Saint Johns in the Island of Newfoundland at present of Waterford Ireland Widow.
I give devise and bequeath all my shares in the Union Bank of Newfoundland and all my New? property estate and effects of every description to my grand daughters Dora M. Wood of Saint Johns aforesaid at present of Waterford aforesaid Spinster Maud E. Wood and Alice Olive Wood both of Saint Johns aforesaid infants all three daughters of William O. Wood, late of Harbour Grace in the Island of Newfoundland aforesaid Barrister at Law in the following shares and proportions that is to say to the said Dora M. Wood ten twenty-sevenths, to the said Maud E. Wood nine twenty-sevenths, and to the said Alice Olive Wood eight twenty-sevenths. I hereby revoke and annul all other and former wills by me at any time made and declare this to be my last will and testament.
I appoint my grandson William Edward Wood of Saint Johns in the Island of Newfoundland Barrister at Law Executor of this my will.
In witness whereof I have set my hand to this my will at Waterford aforesaid this third day of September - A.D. 1894

To Wit I James McCoy of Waterford aforesaid Solicitor make oath and say that on the third day of September A.D. One Thousand Eight Hundred and ninety four at Waterford aforesaid I was present and did see Eliza Francis late of Waterford aforesaid widow the Testatrix named in the paper writing hereunto annexed, duly sign, publish and declare the said annexed paper writing, marked "A" as and for her last Will and Testament in the presence of me and of John Murphy of Waterford aforesaid Auctioneer the other subscribing witness thereto. That I and said John Murphy then and there signed our names to such Will as such witnesses, in presence of the said Testatrix and of each other, and at the time of the said execution of the said Will the said Testatrix was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.
