NEWFOUNDLAND }
St. John's     To Wit    } I John P. Kent of St. John's in the Central District Solicitor do swear that I believe that the Venerable William Forristallate of St. John's aforesaid Roman Catholic Priest deceased, died without a Will; and that I will well and truly administer all and every the Goods of the said deceased and pay his debts, so far as his Goods will extend: and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased which he died possessed of, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of Ten thousand five hundred dollars.

Kent of same place Solicitor acting under Power of Attorney from the next of Kin of the said deceased all of whom are resident without the Jurisdiction of the said Court.

Be it Remembered That on this 28th day of March in the           Year of the Reign of our Sovereign Lady Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of our Lord One Thousand Eight Hundred and Eighty-eight personally appeared John P. Kent of St. John's Solicitor, John Anderson? of same place Merchant and John Cormack of St. John's, Insurance Agent, and did acknowledge themselves to be held and firmly bound to our said Lady the Queen, Her Heirs and Successors, in the penal Sum of Twenty one thousand Dollars to be had, made and levied on his Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following :---

Now the Condition of this Obligation is such, that if the above bounden John P. Kent as Administrator of the Estate and Effects of the Venerable William Forristal late of St. John's Roman Catholic Priest deceased, do make or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said John P. Kent as such Administrator or to the hands or possession of any other person, or persons, for him and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the 28th day of September next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of him the said Administrator or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the 28th day of March which will be in the Year of Our Lord One Thousand Eight Hundred and Ninety six and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.

To the Honorable the Supreme Court of Newfoundland or one of the Honorable the Judges thereof

The Petition of John P. Kent of St. Johns Solicitor

Humbly Sheweth

  1. That the Venerable Archdeacon William Forristalof St. Johns in the Central District Roman Catholic priest died there on or about the Eighth day of September Anno Domini Intestate.
  2. That the said deceased had no near relatives resident within this Colony that all his next of Kin are resident in and about the County of Kilkenny in Ireland and have never been in Newfoundland except one nephew who as your petitioner is informed and verily believes left Ireland aforesaid for America about eleven years ago and has not been heard from since.
  3. That all the said next of kin with the exception of the aforesaid nephew whose place of abode is unknown have by Power of Attorney duly signed and executed them? and dated the Fourteenth day of February last past "and which is hereto annexed marked A" executed and duly authorized your petitioner to take charge of and administer the Estate of the said deceased in their interests.
  4. That to the best of your petitioners knowledge and belief the said deceased died possessed of property consisting principally of moneys ??? within the Jurisdiction of this Honorable Court to the probable value of about Ten thousand dollars.
  5. That your petitioner under the Power of Attorney




    aforesaid is desirous of being appointed administrator of the property Estate and effects which were of the said deceased Venerable Archdeacon Forristal and situate within the jurisdiction of this honorable Court.
  6. That no probate of will or administration to the Estate of the said deceased has been hitherto granted and
    Your petitioner therefore prays that letters of administration be granted to him ???th of this Honorable Court as attorney for the said next of kin and as in duty bound he will ever pray &c &c.

To all to whom these presents shall come We Cathrine Quinn of Durcanane Mooncoin County Kilkenny Ireland Widow of Martin Quinn of same place Farmer deceased Robert Fripps? of Grange in the same County and place Farmer Anastatia Hogan wife of Thomas Hogan of Nicholstown, Mooncoin County Kilkenny Ireland Farmer as next of kin of the Venerable Archdeacon William Forristal late of St. John's Newfoundland, Roman Catholic Priest now deceased. ??nd ???ing Whereas the said Venerable Archdeacon Forristal died at St. John's aforesaid on or about the eighth? day of September last past intestate & without having appointed a legal representative to his estate. And whereas it is deemed advisable to appoint some one to look after the property & effects of the said deceased and to administer in the Newfoundland Courts for the same "with the exception of Rob't  Fripps a nephew of the said deceased who left Ireland for America in the year 1884 and who has not since been ????" we are the sole surviving representatives or next of kin of the said deceased and all being resident outside the jurisdiction of the Courts aforesaid and are desirous of appointing John P. Kent of St. John's aforesaid Solicitor as our representative to administer the said Estate for us. Now this Indenture? witnesseth that we the aforesaid Catherine Quinn, Robert Fripps, Anastatia Hogan and Edward Walsh do and each of us doth hereby nominate constitute and appoint the said John P. Kent of St. John's Solicitor our his & her true and lawful attorney to appear before the Supreme Court of Newfoundland or any of the Honorable the Judges of the said Court and in our place and stead and as our and each of our attorney to apply for and procure Administration to the estate and effects which were of the aforesaid Ven. Archd. Forristal deceased to be granted and committed to him. And our said attorney is hereby authorized and requested to take full control [sic] of the said Estate in the interests of those beneficially entitled thereto & generally to transact and manage everything in connection therewith as fully and effectually to all intents & purposes as if we or anyone or more of us were personally present & did the same in our own proper person. And we and each of us doth hereby agree to ratify and confirm

 

whatever our said attorney shall do cause to be done in or about the said premises for the benefit of those concerned for the better realization of the assets of the Estate. And we hereby declare that these presents shall not be revoked until the said Estate is fully administered and regular releases executed by each and every one of us to the said John P. Kent it being our intent and desire that all matters and things respecting the said Estate and the realization thereof shall be under the full management and direction of our said attorney.   1. That the Venerable Archdeacon William Forristallate of St. John's Central District, Roman catholic Priest died there on or about the 8th day of September A.D 1894 Intestate
  2. That the said deceased had no next of kin resident within this Colony; that all his next of kIn are resident in and about the County Kilkenny in Ireland and have never been in Newfoundland except one nephew who as your petitioner is informed and verily believes left Ireland for America and has not been heard from since.
  3. That all the next of Kin of the said deceased did by Power of Attorney dated the 14th day of February last past request and authorize John P. Kent St. Johns Solicitor to take charge of and administer the estate of said deceased in their interests.
  4. That the said John P. Kent took out administration to said estate in this honorable Court in March last.
  5. That said John P. Kent died at St. Johns aforesaid on the 18th day of November last past without having fully administered the said estate
  6. That your petitioner together with the said John P. Kent carried on the business or practice of the law in partnership with the said John D. Kent under the style




    or from name of J & J Kent at St. Johns aforesaid
  7. That the power of attorney aforesaid from the said next of kin to the said John P. Kent was given him as a member of the said firm of J. & J. Kent
  8. That to the best of your petitioner's knowledge and belief the estate of the said deceased left unadministered by the said John D. Kent does not exceed $6000.00
  9. That your petitioner believes that it is necessary in the interest of the said next of kin and of the said estate of the Venerable Archdeacon William Forristal that an administrator thereof be immediately appointed by this honorable court
  10. That administration of the said estate has not been granted to any one since the death of the late administrator John D. Kent deceased.

          Your petitioner therefore prays that administration of the estate and effects of the said Venerable Archdeacon William Forristal which were left unadminis-tered by the said John P. Kent be granted to him Your petitioner, and as in duty bound he will ever pray &c &c &c.

S.S.          I James M. Kent of St. John's one of His Majesty's Counsel take oath and say as follows:-

  1. I am the administrator of the estate of Revd. William Forristallate of St. John's, Catholic Priest, deceased.
  2. I have to the best of my knowledge information and belief set forth in the account hereto annexed marked No. 1. a full inventory and valuation and to which Reverend William Forristal the intestate who died in the month of September 1894?, was possessed or entitled at the time of his death.
  3. I have according to the best of my knowledge information and belief set forth in the account hereto annexed marked No. 2. a full statement of the estate of the said intestate which has come to my hands or to the hands of any person by my order with names of the persons from whom and on what account the same has been received and also a like statement of the disbursements, allowances, and payments made by me on account of the said intestates funeral expenses, debts and estate, together with the names of the persons to whom and the purposes for which the same were disbursed, allowed or paid.
  4. I have according to the best of my knowledge information and belief set forth in the account hereto annexed marked No. 3 a full statement of the estate of the said intestate now outstanding or undisposed of.
