NEWFOUNDLAND }
St. John's      To Wit   } I William Merchant of St. John's, Gentleman of no occupation do swear that I believe this to be the true Last Will and Testament of Elizabeth Flood late of St. John's, Widow, deceased. I do further swear that I will pay all the Debts and Legacies of the said deceased so far as her Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Elizabeth Flood, deceased, and of which she died possessed, do not, according to the best of my knowledge, judgment and belief, amount to the value of ten thousand five hundred dollars

Three days from date hereof application will be made to the Honorable the Supreme Court or to one of the Honorable the Judges thereof for Probate of the will of ElizabethFlood late of St. John's Widow deceased to be granted to William husband of St. Johns Gentleman the Executor therein named.

To Wit     } I Michael P. Gibb of St. John's Solicitor make oath and say that on the 23rd day of June A.D. One Thousand Eight Hundred and ninety five at St. John's I was present and did see Elizabeth Flood late of St. John's Widow the Testator named in the paper writing hereunto annexed, duly sign, publish and declare the said annexed paper writing, marked A as and for her last Will and Testament in the presence of me and of Richard White the other subscribing witness thereto. That I and said Richard White then and there signed our names to such Will as such witnesses, in presence of the said Testator and of each other, and at the time of the said execution of the said Will the said Testatrix was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.

I Elizabeth Flood of Saint John's Married Woman do make publish and declare the following to be my last will and testament & hereby revoke all other and former wills by me at any time made:-
1st I give devise and bequeath to my brother William Merchant the sum of Four thousand dollars invested by me in the Merchants Estate : -
2nd I give devise and bequeath to my sister Johanna Morris? my interest in the property known as Merchants Estate during her lifetime and on her death to go to my said brother William Merchant if he should predecease my said sister Johanna Morris. I will and bequeath the said interest in Merchants Estate to my sister Maria Cadic? hereto ???? my said sister Johanna Morris I will and devise that my said interest in Merchants Block? shall go to my niece Barbara Cadic daughter of my said sister Maria Cadic and her next of kin.
3rd I will devise and bequeath one fourth part of my share or interest in the Flood Estate to my niece Barbara Cadic daughter of my said sister Maria Cadic -
4th To my niece Minnie Merchant I will devise and bequeath one fourth part of my interest in the said

 

Flood Estate during her life and on her death to go to my said brother William Merchant and if he should predecease my said niece Minnie Merchant I will and devise the said one fourth part to my said sister Maria Cadic and her next of kin -
5th To my niece Barbara Pilot? wife of ??? Pilot I will devise and bequeath one fourth part of my share or interest in the said Flood Estate during her life and on her death ??? ??? to my said brother William Merchant and if he should predecease my said niece Barbara Pilot I will and devise the said one fourth part to my said sister Maria Cadic and her next of kin -
6th To my brother William Merchant I will devise and bequeath one fourth part of my share or interest in said Flood Estate
7th I will and devise that a reasonable time shall be given by my said brother William Merchant to my said sisters Maria Cadic and Johanna Morris for the payment to him of their portion of the said sum of Four thousand dollars bequeathed by me to the said William Merchant for interest in the said Merchant's Estate and that he shall not at any time oppress? my said sisters Maria Cadic and Johanna Morris in

 

forcing payment of their share of the said four thousand dollars. A ??? ??? and ??? that the said legacy of four thousand dollars bequeathed by me to the said William Merchant is a ??? upon the whole of the said Merchant Estate inclusive of my interest bequeathed by me to my said sister Johanna Morris
I appoint my said brother William Merchant Executor of this my will.

The Petition of William Merchant of St. Johns Gentleman

Respectively Sheweth as follows

  1. Elizabeth Flood late of St. John's Widow died there on the 25th day of June last having previously made and executed her last Will and Testament which is hereto annexed marked "A"
  2. The said deceased appointed your Petitioner sole executor of her said Will
  3. The said deceased at the time of her death was possessed of property of the probable value of Ten thousand dollars
  4. No Probate of the will or Letters of Administration of the Estate of said deceased have been previously applied for

          Your Petitioner therefore prays that Probate of the will of said deceased may be granted to him
          And as in duty bound he will ever pray
          Dated at St. Johns this 24th day of August A.D. 1895
