St. Johns
To Wit I William J. Barnes of St. John's in the Central District Hardware Merchant do swear that I believe this to be the true Last Will and Testament of Charles Barnes late of St. Johns aforesaid Librarian, deceased. I do further swear that I will pay all the Debts and Legacies of the said deceased so far as his Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Charles Barnes deceased, and of which he died possessed, do not, according to the best of my knowledge, judgment and belief, amount to the value of Twelve hundred dollars

To Wit I William H? Horwood of Saint Johns aforesaid Barrister at Law make oath and say that on the sixteenth day of May A.D. one thousand eight hundred and ninety four at I was present and did see Charles Barnes late of Saint Johns aforesaid Librarian the Testator named in the paper writing hereunto annexed duly sign, publish and declare the said annexed paper writing marked A as and for his last Will and Testament, in my presence and in the presence of Jean Glendinning the other subscribing witness thereto. That I and said Jean Glendinning then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other, and at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

This is the Last Will and Testament of me Charles Barnes of Saint Johns in the Island of Newfoundland made this sixteenth day of May A.D. 1894. First I give and bequeath unto my son William J. Barnes all the household effects belonging to me. Unto my grandson Charles Barnes son of Mary Barnes I give my silver watch; and I desire that any money in my possession at the time of my death shall be divided, after payment of my funeral and other expenses, amongst my grand daughters share and share alike. And unless the land held by me situate near Belvedere, Long Pond Road be previously disposed of by me I devise the same unto my said son William J. Barnes, Anna Louisa Pope, Edward Francis Barnes share and share alike. And I appoint William J. Barnes aforesaid the Executor of this my Will.
In Witness Whereof I have hereunto subscribed my hand and declar [sic] the foregoing to be my Last Will and Testament

The Petition of William J. Barnes of Saint Johns in the Island of Newfoundland Hardware Merchant
Humbly Sheweth
That Charles Barnes late of Saint Johns aforesaid Librarian died at this place on the eighth day of February instant and possessed at the time of his death property within the jurisdiction of this Honorable Court of the probable value of Twelve hundred dollars
That hereto annexed is the Last Will and Testament of the said Charles Barnes marked "A" and that Your Petitioner is the Executor named in the said Will.
That no application for Probate of the said Will or for Administration to the Estate of the said Charles Barnes deceased has heretofore been made to this Honorable Court.
Your Petitioner therefore humbly prays that Your Honorable Court or one of Your Lordships the Judges thereof will be pleased to grant unto him Probate of the said Last Will and Testament of the said Charles Barnes deceased/
And as in duty bound Your Petitioner will ever pray
At Saint Johns aforesaid this 23rd day of February A.D. One thousand eight hundred and ninety five
