Newfoundland
St. Johns To Wit          I Christopher Yard of Witless Bay in the Central District, Fisherman do swear that I believe this to be the true Last Will and Testament of Matthew Yard late of Witless Bay aforesaid fisherman deceased. I do further swear that I will pay all the Debts and Legacies of the said deceased so far as his Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Matthew Yard deceased, and of which he died possessed, do not, according to the best of my knowledge, judgment and belief, amount to the value of Two hundred and fifty dollars

So help me God

To Wit
I James Murphy of Witless Bay make oath and say that on the fourth day of June A.D. one thousand eight hundred and eighty nine at Witless Bay I was present and did see Matthew Yard late of Witless Bay the Testator named in the paper writing hereunto annexed marked A duly sign by making his mark publish and declare the said annexed paper writing as and for his last Will and Testament, in my presence and in the presence of James Burke the other subscribing witness thereto. That I and said James Burke then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other. That previously to the said Will being so signed as aforesaid, by the said Testator and the said witnesses, it was read over to and approved of by the said Testator in the presence of me and the said James Burke and at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

To the Honorable the Supeme Court of Newfoundland or one of the Honorable Judges thereof.

The petition of Christopher Yard of Witless Bay in the Central District Fisherman

Humbly Sheweth

That Mathew Yard late of Witless Bay died at that place on or about the 4th day of June 1889 having previously made his last will and testament which is hereto annexed proven upon the oath of James Murphy one of the subscribing witnesses thereto.
That by the said last will and testament the testator nominated his son, your petitioner, to be the executor of his said last will and testament.
That at the time of his death the said Matthew Yard was possessed of property within the jurisdiction of the Supreme Court and consisting of house ???ling property and land of the probable value of Two hundred dollars.
No letters of administration or probate of the will of the said Matthew Yard have been granted from this Honorable Court
Your petitioner therefore prays that Probate of the will of the said Matthew Yard may be granted forth of this Honorable Court to him and as in duty bound he will ever pray &c &c &c &c

I Matthew Yard of Witless Bay Fisherman being weak in body (next few words completely obscured) and understanding do make this my last will and testament in the manner and form following.

1st I bequate [sic] my soul to almighty God my body to the earth rottenes [sic] and worms
2nd I bequate to my son Christopher Yard my stage and flake situate at the north side of Witless Bay to geather[sic] with my fishing punt and all my land property situate on the north side of Witless Bay my Wife Johannah Yard is to hold this property in her possession.

during her life then my son Christopher Yard is to inherit it
3rd I bequate to my daughter Margrit[sic] Tobin that garden situate ???ene and occupied by Thomas Yard and (Next few words obscured)
4th I bequate to my sons ??? and Peter Tobin twenty-one feet of waterside property from John Chail[sic] to towards James Walsh Sind [sic] in the prensence [sic] of the undersind [sic] wittines [sic] this fourth day of June One thousand eight hundred and eighty nine being first read for the testeter. [sic]
