To Wit We Frank Wills of St. John's, Commission Merchant, Ellis C. Watson of same place Accountant and Andrew K Lumsden of same place Draper, do swear that we believe this to be the true Last Will and Testament of John Thomas Tapley? Wills of St. Johns aforesaid, Plumber, deceased. We do further swear that we will pay all the Debts and Legacies of the said deceased so far as his Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when we shall be lawfully called thereto. And we do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said John Thomas Tafley Wills, deceased, and of which he died possessed, do not, according to the best of my knowledge, judgment and belief, amount to the value of Two thousand five hundred dollars

The Petition of Frank Corben Wills of St. Johns in the Island of Newfoundland Commission Merchant, Ellis Cornish Watson of the same place and Andrew K. Lumsden of the same place Draper
Humbly Sheweth
That John Thomas Tapley Wills late of St. Johns aforesaid Plumber died at that place on or about the 21st day of July instant having first executed the paper writing hereto annexed as and for his last Will and Testament and having appointed your petitioners the executors thereof.
The said deceased, at the time of his death was possessed of property of the probable value of two thousand four hundred dollars.
That no Probate to the Will or Administration to the Estate and effects of the said deceased has been at any time granted.
Your Petitioners therefore pray that this Honorable Court or one of the Honorable Judges thereof will be pleased to grant to your Petitioners Probate to the said last will and Testament of the said John Thomas Tapley Wills.
And as in duty bound your Petitioners

To Wit I Henry Thomas Payne of St. Johns Shopkeeper make oath and say that on the tenth day of July A.D. one thousand eight hundred and ninety four at St. John's I was present and did see John Thomas Tapley Wills late of St. Johns Plumber, the Testator named in the paper writing hereunto annexed duly sign, publish and declare the said annexed paper writing marked A as and for his last Will and Testament, in the presence of me and of William James White the other subscribing witness thereto. That I and said William James White then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other, and at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

I John Tapley Wills now residing in the City of St. Johns in the Island of Newfoundland by occupation a Plumber, being of Sound mind, after due consideration and deliberation, do make this document my Last Will and Testament.
I give, bequeath and devise unto my son James Richard Jurneaux? Wills all my personal property and Real Estate, whether in my own name or in my deceased wife's name, Mary Wills.
To Have and to Hold the same for his maintenance, during his natural life and after his demise, to be leased for the maintenance of my son, Samuel Edward Wills, provided he lives a single life and does not marry, in which case, if he does marry, all my personal property and real estate to be sold or divided into equal shares or parts and each of my sons and daughters to receive their proportionate share of the net proceeds, or parts thereof.
And I do appoint Frank Corben Wills my son and Ellis Cornish Watson and Andrew K. Lumsden, my son-in-law my executors to carry out my wishes in every respect.
