Saint-John's To Wit:    }

I do swear that I believe that Anne Catherine Weston Tessier late of Saint John's in the Central District of the Island of Newfoundland widow deceased died with -------- a Will; and that I will well and truly administer all and every the Goods of the said deceased, and pay her Debts so far as her Goods will extend; and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of her Administration into the Registry of the said Court, within Six months after the date hereof, or when I shall be thereunto lawfully required; and that the whole of the goods, rights, chattels, assets, credits and effects of the said deceased, of which she died possessed, within the jurisdiction of this Court, do not, according the best of my knowledge, judgment and belief amount to the value of Four Thousand Dollars.

So help me GOD.

          The Petition of Anne Caroline Maria Tessier of S John's, Single woman,

Humbly Sheweth:

That Petitioners mother Anne Catherine Weston Tessier late of S John's Merchant deceased died at S John's in the month of January, last past having first made her last Will and Testament which is hereunto annexed marked 'A'. That annexed hereto is the affidavit of Charles W.H. Tessier of S John's Merchant Stepson of the said Testatrix (a person acquainted with the handwriting of the Testatrix) in proof that the said Will is wholly in the handwriting of the said Anne Catherine Weston Tessier.
That your Petitioner is the sole Legatee under the said Will
          That under the said Will no Executor has been appointed by the said Testatrix
          That deceased was possessed of money and property at the time of her decease of the probable value of ------- four thousand dollars
          That the said Will has not as yet been probated, nor has probate of any will of deceased, nor has any admin- -istration to the Estate and Effects deceased been granted to any one

Your Petitioner therefore prays that Administration with the Will annexed may be granted to her as the sole LegatEE under the sid Will or to such other person as Your Honourable Court or your Lordship may direct and appoint.
          And as in duty bound your Petitioner will ever pray

I Charles William H. Tessier of Saint John's Merchant make oath and say as follows:

  1. That I am the stepson of Anne Catherine Weston Tessier late of Saint Johns deceased, Widow of my father the late Peter Germon Tessier of S Johns Merchant deceased
  2. That annexed hereto marked A is a paper writing purporting to be and which I believe to be the true last Will and Testament of my said stepmother the said Anne Catherine Weston Tessier who died at Saint John's aforesaid on the thirtieth day of January last past.
  3. That I am forty years of age and am well acquainted with the handwriting of the said Testatrix. That the said Will from the words "St John" down to the word "witness" is wholly in the true and proper handwriting of the said Testatrix. That the name of the said Testatrix "Anne Catherine Weston Tessier" written in the fourth line of writing of the said Will is the true signature of the said Testatrix Anne Catherine Weston Tessier.
  4. That at the date of the said Will viz: on the twentieth day of October --- one

    One Thousand Eight hundred and ninety three (October 20th 1893) the said Testatrix was of sound and disposing mind memory and understanding to the best of my Judgment Knowledge and belief

That after the decease of the said Testatrix the said annexed Will was found in her writing-desk in which the Testatrix Kept her other private letters and papers in her private residence at River Head S John's

This is the last Will and Testament of me Anne Catherine Weston Tessier wife of Peter Germon Tessier of Saint John's Newfoundland, and make with his assent and approval, as Certified by his Signature hereto __
I give divide and bequeath unto my dear Children Weston Gladstone and Anne Caroline Maria, all my right title and interest in and to all my Shares in the Union and Commercial Banks of Newfoundland and all other property to which I am now or may become entitled Share and Share alike and to their respective lawful issue, the Share to my said daughter Anne Caroline Maria not to be subject to the debts contained and engage-ments of any husband whom she may marry - and in the event of the death

of either of them without lawful issue, then to the survivor or Lesor (?) her issue as the Case may be, and Should both die without leaving sur-viving issue - then I devise and bequeath all my said Shares - and all other property to which I am or may become entitled to the Sons of my late Sister Jane Caroline Tessier Share and Share alike, and to their lawful representatives, with benefit of survivors High(?) in case of the death of either without surviving issue -
This my last Will and Testa-ment to be as effectual to all intentS and Purposes as if I were Sole and unmarried, and as if ex-ecuted in the name of Anne Catherine Weston Carter - I appoint my dear husband Peter Germon Tessier to be the sole Executor of this my Will

Be it Remembered, That on this fourteenth day of November in the Fifty-eighth Year of the Reign of Our Sovereign Lady VICTORIA, by the Grace of GOD, of the United Kingdom of Great Britain and Ireland, QUEEN, Defender of the Faith, &c., and in the Year of Our Lord One Thousand Eight Hundred and Ninety-four personally appeared Anne C.M. Tessier of Saint John's in the Central District Spinster, Charles W.H. Tessier and John B. Ayre of the same place Merchants and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal sum of Eight Thousand dollars to be had, made, and levied on their Goods, Chattels, and Effects jointly and severally if default is made in any of the Conditions following:---

Now the Condition Of this Obligation is such, that if the above bounden Anne C M. Tessier as Administratrix with the Will annexed --------------------------- of the Estate and Effects of Anne C W Tessier late of Saint John's widow --------------- deceased, do make, or cause to be made, a just, true and perfect Inventory of all and singular, the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of her the said Anne C M Tessier as such Administratrix or to the hands or possession of any other person or persons, for her and the same so made do exhibit, or cause to be exhibited, into the Supreme Court of Newfoundland, at or before the fourteenth day of May ----------- next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of her death, or which at any time afterwards shall come to the hands or possession of her the said Anne C M Tessier or to the hands or possession of any other person or persons for her shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of her said Administration, on or before the fourteenth day of November which will be in the year of Our Lord One Thousand Eight Hundred and Ninety-five and afterwards from time to time as she shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Adminis-tration account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in a due course of Administration, or in such manner as the said Court shall direct;--- then this Obligation to be void and of no effect, or else to be and remain in full force and virtue.
