AFFIDAVIT.

In the Supreme Court of Newfoundland.

NEWFOUNDLAND, }
St John's   To Wit:       } I, William Knox of St John's aforesaid, Laborer ------------------ do swear that I believe that William Sears late of St John's aforesaid, Laborer ---------- deceased died without a Will; and that I will well and truly administer all and every the Goods of the said deceased, and pay his Debts so far as his Goods will extend; and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within Six months after the date hereof, or when I shall be thereunto lawfully required; and that the whole of the goods, rights, chattels, assets, credits and effects of the said deceased, of which he died possessed, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of Eighty five ------------------------------------------- Dollars.

So help me GOD.

Notice

Three days from the date hereof application will be made to the Honourable the Supreme Court or to one of the Honourable the Judges thereof for Letters of Administration to the Estate of William Sears late of St. Johns Labourer deceased to be granted to William Knox of the same place Labourer a Creditor of the Estate of said deceased

To the Honourable the Supreme Court or to one of the Honourable the Judges thereof.

          The Petition of William Knox of St Johns Labourer

Humbly Sheweth

  1. That William Sears of St. Johns aforesaid Labourer died intestate at that place on or about the 24th day of December last past.

  2. That the said William Sears left him surviving two nephews viz James Sears and John Sears both of St. Johns Labourers.

  3. That the said William Sears at the time of his decease was possessed of property to the value of Eighty One Dollars

  4. That no Administration has been at any time granted to the said Estate.

  5. That the two nephews James Sears and John Sears have neglected to take out Letters of Administration to the said Estate and refuse to consent to any legal representative being appointed to administer the goods and Effects of the said Estate.

  6. That the said William Sears at the time of his decease was indebted to your petitioner in the sum of One hundred and Sixty Dollars for Board Lodgings and other necessaries supplied to the William Sears during his lifetime.

  7. That the burial expenses of the said William Sears amount

    to Forty Four Dollars the payment of which sum has been guaranteed by your Petitioner

  8. That your Petitioner was frequently informed by the said William Sears that there was a sufficient sum of money in the Savings Bank to his credit to pay your petitioner for the said Board Lodging and other necessaries and also to liquidate every indebtedness attend and upon the burial of the said William Sears.

Your Petitioner therefore prays that Letters of Adminis-tration to the Estate of the said William Sears may be granted to him or to such other person as your Honourable Court may deem expedient.

And as in duty bound your Petitioner will ever pray &c &c.

Be it Remembered, That on this 20th day of March in the 57th Year of the Reign of Our Sovereign Lady VICTORIA, by the Grace of GOD, of the United Kingdom of Great Britain and Ireland, QUEEN, Defender of the Faith, &c., and in the Year of Our Lord One Thousand Eight Hundred and Ninety-four personally appeared William Knox of St John's in the Central Distrct Laborer, Michael Myrick of St John's Undertaker and James H. Martin of same place Gentleman ---------------------------------------------------- and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal sum of One hundred and seventy dollars to be had, made, and levied on their Goods, Chattels, and Effects jointly and severally if default is made in any of the Conditions following;---

Now the Condition Of this Obligation is such, that if the above bounden William Knox ----------as Administrator of the Estate and Effects of William Sears late of St John's aforesaid Carpenter, deceased, do make, or cause to be made, a just, true and perfect Inventory of all and singular, the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said William Knox as such Administrator or to the hands or possession of any other person or persons, for him and the same so made do exhibit, or cause to be exhibited, into the Supreme Court of Newfoundland, at or before the 20th day of September next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come to the hands or possession of him the said William Knox or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the 20th day of March which will be in the year of Our Lord One Thousand Eight Hundred and Ninety-five and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder upon the said Adminis-tration account , the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in a due course of Administration, or in such manner as the said Court shall direct:--- then this Obligation to be void and of no effect, or else to be and remain in full force and virtue.
