AFFIDAVIT.

In the Supreme Court of Newfoundland
-------------------------------

NEWFOUNDLAND,  } I Ellen Roach of Branch in
St. John's To Wit:         } St Mary's Bay (at present of St John's) Widow ---------------------- do swear that I believe that Patrick Roach late of Branch, aforesaid, Planer ------------------------- deceased died with----------------- a Will; and that I will well and truly administer all and every the Goods of the said deceased, and pay his Debts so far as his Goods will extend; and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within Six months after the date hereof, or when I shall be thereunto lawfully required; and that the whole of the goods, rights, chattels, assets, credits and effects of the said deceased, of which he died possessed, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of eight hundred and fifty ------- Dollars.

So help me GOD.

In the Name of God Amen,

I, Patrick Roach of Branch being of sound mind but feeling my last end draw near do hereby make my last will and testament.

To my dearly beloved wife Ellen Roach I give and bequeath all the property, real or personal that I may die possessed of whether land, fishing, household, property, stock or of any other nature or kind for her use and benefit during the term of her natural life.

To my son William Roach, after my wife's death aforesaid, I leave one half of my fishing property, the whole consisting of one stage, three stores, two flakes and a beach and deducting one half of the meadow known as Sullivans, or such

Portion of as may now be in my possession and the meadow Near my house known as the Hill meadow. I bequeath one half of the remainder of my land to him, my son William as aforesaid.

To my Son Joseph Roche, I give and bequeath after my wifes death as aforesaid, a like share both of land and fishing property as that already devised to my son William.

To my Son John Roach I give and bequeath one half that portion of the meadow Known as Sullivan's now in my possession.

To my daughter Mary Roach I give and bequeath that meadow near my Dwelling House known as the Hill meadow, also to her my daughter the said Mary Roach I give and bequeath my Dwelling House with all the furniture Household goods and utensils contained therein - provided always that none of these bequests is to come into force until after my wife's death.

In witness whereof I have hereunto Set my hand and affixed my Seal at Branch on this Second day of February A.D. 1892.

S.S.              } I, John F. Roach of Branch S Marys Bay make oath and saith as follows:

  1. That I was present on the day of the date thereof and did see Patrick Roach late of Branch aforesaid Planter duly sign (by putting his mark thereto) publish and declare the annexed paper writing as and for his last Will and Testament in the presence as well of this deponent as of Peter Sinnott the other subscribing witness thereto
  2. That immediately before the said Will was so executed by the Testator as aforesaid the same was duly and fully read over and explained to him in my presence and in the presence of the other Subscribing witness - both witnesses being present at the same time.
  3. That after the said Testator had so signed the said Will as aforesaid this deponent and the said other Witness Peter Sinnott then and there in the presence of the said Testator and in the presence of each other duly sub-scribed their names as witnesses to the due and formal execution of the said Will
  4. And this deponent further saith that at the time of the execution of the said Will the said Testator was of sound and disposing mind memory and understanding to the best of this deponents judgment knowledge and belief

          The Petition of Ellen Roach of Branch St Mary's Bay Widow

Humbly Sheweth

That Petitioner's husband Patrick Roach late of Branch aforesaid Planter died at that place in the month of June A.D. 1892 having first made his last Will and Testament which is hereunto annexed proved upon the oath of John F. Roach one of the Subscribing Witnesses thereof
That deceased appointed no executor to the said Will.
That deceased left him Surviving your Petitioner and as next of Kin Seven Sons and Six daughters all of who are married except one daughter living with Your Petitioner

That deceased was possessed of property at the time of his death of the probable value of Eight hundred dollars.
          That a letter of probate of the

annexed Will nor Administration to the Estate and Effects of deceased has as yet been granted to any one
          Your Petitioner therefore humbly prays that Administration with the Will annexed may be granted to her, And as in duty bound she will ever pray

                    Be it Remembered,
That on this 28th day of May in the 57 Year of the Reign of Our Sovereign Lady VICTORIA, by the Grace of GOD, of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c., and in the Year of Our Lord One Thousand Eight Hundred and Ninety four personally appeared Ellen Roach of Branch in St Mary's Bay Southern District, Widow, Henry Roach of Branch Fisherman and Stephen Roach Planter ------------------- and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal Sum of Seventeen hundred Dollars to be had, made, and levied on their Goods, Chat-tels, and effects jointly and severally if default is made in any of the Conditions following:---

Now the Condition Of this Obligation is such, that if the above bounden Ellen Roach ---- ---- as Administratrix cum testamento annexo of the Estate and Effects of Patrick Roach late of Branch aforesaid Planter deceased, do make, or cause to be made, a just, true and perfect Inven-tory of all and singular, the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or know-ledge of her the said Ellen Roach as such Administratrix ---------------------------------- or to the hands or possession of any other person or persons, for her and the same so made do exhibit, or cause to be exhibited, into the Su-preme Court of Newfoundland, at or before the 28th day of November next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels. Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come to the hands or possession of her the said Administratrix ------------------------------ or to the hands or possession of any other person or persons for her shall well and truly admin-ister according to Law, and further shall make, or cause to be made, a just and true account of her said Administration, on or before the 28th day of May which will be in the year of Our Lord One Thousand Eight Hundred and ninety five and afterwards from time to time as she shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration ac-count, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in a due course of Adminis-tration or in such manner as the said Court shall direct;---then this Obliga-tion to be void and of no effect or else to be and remain in full force and virtue.
