AFFIDAVIT.

In the Supreme Court of Newfoundland.

NEWFOUNDLAND, } I, James Goodfellow of St John's in the Central District
St John's   To WIT:      } Merchant ----------------- do swear that I believe this to be the Last Will and Testament of Marian Reynolds late of St John's aforesaid, Widow, deceased

I do further swear that I will pay all the Debts and Legacies of the said deceased so far as her Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Marian Reynolds, deceased, of which she died possessed, do not, according to the best of my knowledge, judgment and belief, amount to the value of Ten thousand five hundred dollars - - - - - - - -

          I Marian Reynolds of S. Johns do make this my last will and Testament.
          I direct that all my just debts, funeral and testamentary expenses shall be paid
          I give and bequeath to Mrs. Jessie McNeily the sum of Eight Hundred dollars.
          I give and bequeath to my Executor hereinafter named, a sufficient sum of money from my general Estate, upon trust, which will provide an annual allowance of Two hundred dollars for Mrs. Alice M. McNeily, which said annual allowance of Two hundred dollars shall be paid in equal quarterly payments, to the said Mrs Alice M. McNeily during her natural --- life, from the date of my deceased, and until such sum shall be invested, such payments shall be paid out of the profits of my general Estate and after the decease of the said Alice M. McNeily, my Executor shall hold the principal money or Securities therefore, upon trust, to realize divide and distribute the securities or freed as the said Alice M. McNeily by her Will and testament directs.
          The residue of my Estateof whatever kind I give and bequeath to my sisters Isabella W. Rogerson and Rosina Goodfellow share and share alike.
          I appoint James Goodfellow my sole Executor of this my last Will and

To Wit          } I Enoch Fry of St John's Coachman ----------------------------------------- make oath and say that on the ninth day of March A. D. One Thousand Eight Hundred and Ninety Four at St John's aforesaid I was present and did see Marian Reynolds late of St John's aforesaid Widow deceased the Testatrix named in the paper writing hereunto annexed, duly sign, publish and declare the said annexed paper writing, marked A as and for her last Will and Testa-ment in the presence of me and of Mary Bidgood of St John's aforesaid, Housemaid the other subscribing witness thereto. That I and said Mary Bidgood -------------------------------------------- then and there signed our names to such Will as such witnesses, in presence of the said Testatrix and of each other, and at the time of the said execu-tion of the said Will the said Testatrix was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.

The Petition of James Goodfellow of St John's Merchant

Humbly Sheweth,

                    That
Marian Reynolds of St John's aforesaid Widow died at St John's on the first day of August now present having made and published her last will and Testament hereto annexed of which Petitioner is appointed Executor.

                    That
Said Marian Reynolds was at the time of her death possessed of property within the jurisdiction of this Court not Exceeding in value the sum of Ten Thousand Dollars.

                    That
no Probate or Administration in respect of her Estate has been heretofore granted or applied for.

                    That
Petitioner is desirious that Probate of the said will should be granted and prays

 

prays that grant thereof be made to him
          And as in duty bound &c/
