Estate of Catherine Redmond 1894

This is the last will and testament of me Catherine Redmond of St. John's in the Central District Widow of James Joseph Redmond of the same place Cabman deceased
1st I devise and bequeath unto my grandson James Silvey the house in which I now reside in Codey's Lane.
2nd I devise and bequeath unto my grandson Thomas Redmond the downstairs portion of the house in Codey's Lane situate next door to the house in which I now reside.
3rd I devise and bequeath unto my granddaughter Catherine Cole the upstairs portion of the said house in Codey's Lane situate next door to the house in which I now reside
4th I leave the sum of Forty Dollars to cover the expenses of my funeral
5th I leave the sum of Forty Dollars to be expended upon a tombstone to be erected to the memory of myself my husband and family
6th I will and bequeath the sum of Twenty Dollars to the Reverend John Ryan of St. Patrick's Church in St. John's.
7th I will and bequeath the sum of Twenty Dollars to the Reverend E.      Crook of St. Patrick's Church in St. John's.
8th The next real residue and remainder of my Estate I will and bequeath to my five grandsons the sons of the late Bridget Silvey, namely Patrick Silvey, John Silvey, Thomas Silvey, William Silvey and Joseph Silvey, share and share alike.
And it is my express will and desire that every legacy and bequest made hereunder shall be taken in substitution

of and in (?) as in addition to any share or interest which they have or might have in the Estate of my late husband James Joseph Redmond.
I appoint the Reverend E.      Crook of St. Patrick's Church in St. John's to be the Executor of this my last will and testament

I Herbert E. Knight of St. John's aforesaid Solicitor make oath and say that on the Twenty first day of Feruary A.D., One Thousand Eight Hundred and Ninety ------------------------ at St. John's aforesaid I was present and did see Catherine Redmond late of St. John's aforesaid Widow the Testatrix named in the paper writing hereunto annexed, duly sign, publish and declare the said annexed paper writing, as for her last Will and Testament in my presence, and in presence of Francis Madigan of St. John's aforesaid the other subscribing witness thereto. That I and said Francis Madigan then and there signed our names to such Will as such witnesses, in the presence of the said Testatrix and of each other and that at the time of the said execution of the said Will the said Testatrix was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.

The Petition of the Reverend Edmund Crook of St. John's in the Central District, Catholic Clergyman

Humbly Sheweth,

  1. That Catherine Redmond late of St. John's in the Central District Widow of the late James Joseph Redmond lately died having first made and published her last will and testament which is hereto annexed.
  2. That at the time of her decease the said Catherine Redmond was possessed of property within the jurisdiction of your Honourable Court of the probable value of nine Hundred Dollars.
  3. That the said Catherine Redmond left her surviving as next of kin nineeight grandchildren namely Thomas Redmond and Catherine Cole who reside beyond the jurisdiction of your Honourable Court and James Silvey, Patrick Silvey, John Silvey, Thomas Silvey, William Silvey and Joseph Silvey who are infants and reside within the jurisdiction of your Honourable Court.
  4. That in her last will and testament the said Catherine Redmond named Your Petitioner sole executor of her said will.
  5. That no probate to any will or letters of administration to the Estate of the said Catherine Redmond have been granted or applied for.

Your Petitioner therefore prays that Probate of the said last will and testament of the said Catherine Redmond may be granted to him
          And, as in duty bound, Your Petitioner will ever pray, &c.

          I do swear that I believe this to be the true Last Will and Testament of Catherine Redmond late of Saint John's in the Central District Widow deceased I do further swear that I will pay all the Debts and Legacies of the said deceased so far as her Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Catherine Redmond, deceased, and of which she died possessed, do not, according to the best of my knowledge, judgment and belief amount to the value of Nine hundred dollars

So help me GOD.
