NEWFOUNDLAND, } I Susannah Quinton of
St John's   To Wit:       } red Cliff, Bonavista Bay (but at present of St John's) Widow do swear that I believe that Joliffe Quinton late of Red Cliff aforesaid, Fisherman deceased
deceased died without a Will; and that I will well and truly administer all and every the Goods of the said deceased, and pay his Debts so far as his Goods will extend; and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within Six months after the date hereof, or when I shall be thereunto lawfully required; and that the whole of the goods, rights, chattels, assets, credits and effects of the said deceased, of which he died possessed, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of two thousand four hundred Dollars.

So help me GOD.

The petition of Susannah Quinton of Red Cliff in Bonavista Bay widow

Humbly sheweth

  1. That your petitioner's late husband John Quinton late of Red Cliff aforesaid trader died there on the fourth day of March A D 1893 intestate and letters of administration of his Estate have been duly granted to your petitioner.
  2. Joliffe Quinton a brother of the said John Quinton died at Red Cliff aforesaid on the 29th day of November A.D. 1890 in-testate unmarried and never having married leaving him surviving as next of Kin his said brother John, a sister Abigail, wife of widow of Robert Penney late of Keels in Bonavista Bay, and the following nephews and nieces, that is to say, children of his Deceased brother William Quinton 1 Charles, 2 John, 3 Joliffe, 4 George, 5 Jacob, 6 Francis, 7 William, 8 Henry, 9 Martha, and 10 Elizabeth; children of his deceased sister Mary, 11 George, and 12 Martha; and children of his deceased sister Jedia, 13 William, 14 George, 15 Charles, 16 Joseph, 17 John, and 18 Elizabeth. The hus-band of said sister Mary was Christo-pher Quinton of Red Cliff aforesaid and the husband of said sister Jedia was

  3. The said deceased Joliffe Quinton was of the age of seventy years at his death. He was a cripple and had done no work what so ever for about twenty years previous to his death; during all which time he was provided for in Every way, with board, lodging, and main-tenance by day(?) in the house of his said brother John.
  4. By reason of such maintenance, the said Joliffe deceased never having made any payment or compensation therefor, he was indebted at his death to his said late brother John, and the Estate of said late Joliffe is yet in-debted to the Estate of said late John Quinton in a sum not less than two thousand --------------- dollars.
  5. It was the intention and desire of said late Joliffe Quinton that all his Estate should go to his said late brother John in consideration of such maintenance.
  6. The Estate of the said late Joliffe Quinton at his death consisted of the sum of $2354.72 in the Newfoundland Savings Bank with interest from the beginning of the year 1890. Out of that sum his funeral and other necessary expenses were paid by his late brother John.

  7. There is now in the said Bank in the name of said late Joliffe Quinton the sum of $2427.22 and interest from the end of the year 1891.
  8. By deed hereto annexed marked (A) the said Abigail Penney has conveyed to our petitioner as administratrix afore-said all her interest in the Estate of the said late Joliffe deceased and has consented that letters of administra-tion of the Estate of her late brother Jo-liffe be granted to your petitioner.
  9. No letters of administration of the Estate of the said late Joliffe Quinton have been granted

Your petitioner humbly prays that letters of administration of the said Estate may be granted to her and as in duty bound she will pray

          Whereas my late brother Joliffe Quinton late of Red Cliffe in Bona-vista Bay deceased resided with my late brother John Quinton late of Red Cliffe aforesaid during the lifetime of the said Joliffe Quinton and the said Joliffe was a cripple for many years and during about twenty years was maintained and supported by his said brother John at the house of the latter in Red Cliffe aforesaid where he died in the latter part of the year 1890 and the said John Quinton has lately died leaving his widow Susannah and seven children the said children being all under the age of twenty one years and the Estate of the said Joliffe Quinton is and was at his death indebted to the late John Quinton and his Estate for the said support and maintenance and the said Joliffe Quinton intended and was desirous that his Estate should go to his said late brother John. And whereas the said Joliffe Quinton and John Quinton both died with-out having made a will and the intestate Estate of the said Joliffe Quinton of right belongs to the said widow and children of his said late brother John and I am desi-rous of transferring to the said widow

widow and children of my said late brother John all my interest in the Estate of my late brother Joliffe (the said Joliffe having ne-ver married) Now these prescrits (?) w'held (?) that in consideration of the premises and of the sum of one dollar to me paid by the said Su-sannah Quinton as Administra-trix of the Estate and Effects of my said late brother John Quinton I Abigail (Quinton) now Abigail Penney of Keels in Bonavista Bay aforesaid widow of Robert Penney late of Keels aforesaid merchant deceased have granted assigned transferred sold and set over and by these prescrits do grant assign transfer sell and set over unto the said Susannah Quinton ad-ministratrix of my said late brother John's Estate all my right title interest or share of in or to the Es-tate of my said late brother Joliffe of what nature or kind so ever and of whatsoever the said Estate may consist To Hold the same grants the said Susannah Quinton as admi-nistratrix aforesaid / to the End and interest that the same may be long to and be divided between herself and my said brother John's children / who are the next of kin of the said John Quinton and Entitled to his intestate

intestate Estate / in the same shares and proportions as such intestate Estates are distributed that is to say one third to the widow and two-third among the children survi-ving at the death of the said late John Quinton and subject in all other respects to the usual manner of division or inheritance of intestate Estates in Newfoundland

Be it Remembered,
That on this 4th day of June in the Year of the Reign of Our Sovereign Lady VICTORIA, by the Grace of GOD, of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c., and in the Year of Our Lord One Thousand Eight Hundred and ninety four personally appeared Susannah Quinton of Red Cliff in Bonavista Bay Widow, James Gordon of St John's in the Central District and William Frew of St John's Merchant and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal Sum of Forty eight hundred dollars to be had, made, and levied on their Goods, Chat-tels, and effects jointly and severally if default is made in any of the Conditions following:---

          Now the Condition of this Obligation is such, that if the above bounden Susannah Quinton ---- as Adminisratrix ------------------------------------ of the Estate and Effects of Joliffe Quinton late of Red Cliff aforesaid, Fisherman deceased, do make, or cause to be made, a just, true and perfect Inven-tory of all and singular, the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowl-edge of her the said Susannah Quinton as such Administratrix ------------------------------------ or to the hands or possession of any other person or persons, for her and the same so do exhibit, or cause to be exhibited into the Su-preme Court of Newfoundland, at or before the 4th day of December next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come to the hands or possession of her the said Administratrix or to the hands or possession of any other person or persons for her shall well and truly admin-ister according to Law, and further shall make, or cause to be made, a just and true account of her said Administration, on or before the 4th day of June which will be in the year of Our Lord One Thousand Eight Hundred and ninety five and afterwards from time to time as she shall be lawfully required. And all the rest, residue and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Admin-istration account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in a due course of Administration, or in such manner as the said Court shall direct;---then this Obligation to be void and of no effect or else to be and remain in full force and virtue.
