Notice

Three days after date application will be made to the Honorable the Supreme Court or one of the Honorable the Judges thereof for probate of the last will and testament of John Power late of St Johns Carpenter to be granted to the Executor therein named

I John J. Carew------------ of----- St Johns aforesaid undertaker and carpenter do ------------------ make oath and say that on the twenty Sixth day of January A.D., One Thousand Eight Hundred and Ninety and Eighty nine at St Johns aforesaid ----------------- I was present and did see John Power Carpenter late of the same place ----------------------------------------- the Testator named in the paper writing hereunto annexed, duly sign, publish and declare the said annexed paper writing, as and for his last Will and Testament in my presence, and in the presence of Robert Holden of St Johns New-foundland Attorney at law since deceased -----------------------------------the other subscribing witness thereto. That I and said Since deceased Robert Holden aforesaid ------------- then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other ------------------------------------------------------- and that at the time of the said executions of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.

This the last will and testament of me John Power of Saint Johns in the Island of Newfoundland
I ??? being of sound mind memory and understanding Do this twenty Sixth day of January in the year of our Lord one thousand Eight Hundred and Eighty nine make and publish this my last will and testament in manner following
That is to say I give and bequeath to my beloved wife Mary Power after my death for and during her life things(?) to have and enjoy all and singular the Dwelling House Garden and premises which we now occupy situate on the North Side of Signal Hill Road No 39 situate and being in Saint Johns aforesaid in the Island aforesaid to have and to hold to my said wife the said premises aforesaid during her life time also after my death I give and bequeath to my said wife Mary the sum of one hundred and ten pounds for her sole use and benefit. And after my said wifes death I give the said Dwelling House Garden and premises to my Children Patrick Power John Power Catherine Buckley and Alice French their heirs

Heirs and assigns for ever.
Also I give and bequeath to the Reverend Father Forrestal, the Reverend John Scott and the Reverend Father Ryan the sum of four pounds each for Novena (?) being (?) said for the repose of the souls of my self and my deceased wife Alice.
I also allow to my said Executor herein after mentioned the sum of seven pounds for my funeral expenses and also fifteen shillings for expenses of digging my grave and sodding the same and after my death all the rest and residue of my person estate whosoever and wheresoever and of estate(?) nature kind and quality the same may be and not herein bequeathed giving and disposed of I do give and bequeath unto the said Patrick Power John Power Catherine Buckley and Alice French their and each of their heirs and assigns when and where alike to and for their own use and benefit absolutely. And I do hereby con- -stitute and appoint John J Carew sole Executor to this my Last Will and testament. In Witness whereof I have hereunto set my hand and seal this day and year first above written.

The Petition of John J. Carew of St Johns undertaker and builder

Humbly Sheweth

That John Power late of St John's Carpenter died at that place on the twenty second day of December A.D. 1893
That previous to his death the said John Power made his last will and testament and therein appointed your petitioner as Executor which will and is hereto annexed.
That since the execution of Said will Robert Holden the other subscribing witness thereto who Signed Said will in the presence of your petitioner has died predeceasing the deceased John Power.
That the Estate left by the Said John Power does not Exceed the value of twenty two hundred dollars currency

I do swear that I believe this to be the true Last Will and Testament of John Power late of St John's in the Central District Carpenter deceased I --------- do further swear that I will pay all the Debts and Legacies so far as his Goods shall extend, and the law shall bind me; and that I will exhibit a full, true and perfect Inentory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said John Power, deceased, and of which he died possessed, do not, according to the best of my knowledge, judg-ment and belief, amount to the value of Twenty two - hundred dollars
