AFFIDAVIT.

In the Supreme Court of Newfoundland.

NEWFOUNDLAND, } I, Edward P. Morris of St John's
St John's To WIT:        } in the Central District, Barrister do swear that I believe this to be the true Last Will and Testament of John Nagle late of St John's aforesaid, Victualler deceased, I --------- do further swear that I will pay all the Debts and Legacies of the said deceased so far as his Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said John Nagle, deceased, and of which he died possessed, do not, according to the best of my knowledge, judgment and belief, amount to the value of one thousand five hundred dollars

So help me God.

I give notice that I will outtio(?) execution(?) of three days from the date hereof apply to the Supreme Court for probate to the will of John Nagle late of Saint Johns victualler deceased to be granted to the Hon E.P. Morris the executor named in the said will.
          Dated at St Johns this 17th day of February AD 1894

This is the last will and testament of me John Nagle of Saint Johns victualer made this 10th day of February AD 1894. I give devise and bequeath to Patrick green of Saint Johns Pulster(?) residing Corner Adelaide St. the sum of two hundred dollars. To Mrs. Ellen Morrisey with whom I now reside the sume of one hundred dollars and also my bed and bedding. I desire that my Executor shall devote one hundred dollars towards my funeral Expenses and one hundred dollars for The celebration of masses for my soul. If after the said sums are paid any amount still remains in the hands of my Executor I give devise and bequeath the said sum to the above parties to be divided amonst them in the same proportion as the above sums. I appoint Hon E.P. Morris Executor of this very will.
Signed by the said testator in the presence of us who in his presence and in the presence of each other hereto annex our names as signatures the day and date above.

Saint John's to WIT:    }
I William Morris ---------- of Saint Johns Fisherman -------------- make oath and say that on the Tenth - day of February A.D., One Thousand Eight Hundred and Ninety-four ---------------- at Saint Johns --------------------- I was present and did see John Neagle ------------------ late of St Johns ------ Victualler ------------------- the Testator named in the paper writing hereunto annexed, duly sign, publish and declare the said annexed paper writing, as and for his last Will and Testament in my presence and in the presence of Honourable E.P. Morris of St John's Solicitor and of Patrick Kavanagh also of St John's Cooper --------- the other subscribing witness thereto. That I and said Hon E.P. Morris and Patrick Kavanagh -------------------------------- then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other ------------------------- and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.

To the Honorable the Supreme Court or one of the Honorable the judges Thereof. The petition of Edward P Morris of Saint Johns Barrister at law humbly sheweth as follows That John Nagle late of Saint Johns in the island of Newfoundland victualer died at the above place on the 11th day of February AD 1894 having previously made his last will and testament which is hereto annexed proven upon the oath of William Morris one of the subscribing witnesses Thereto. That previous to his death deceased was possessed of properties in jurisdiction of this Court of the probable value of fifteen hundred dollars. That under the said will your petitioner was appointed Executor. That no probate to any will or letters of administration has as yet been granted to any person Petitioner therefore prays that Probate of the said will may be granted to him and as in duty bound he will Ever pray
