After three days from date hereof application will be made to the Honorable The supreme court or to one of the Honorable the Judges thereof for Probate of the will of Jno M. L. Muir late of Bonne Bay Trader deceased to be granted to Simeon Avery Jno R. Roberts and Francis Cox of Bonne Bay the Executors named in said will.

Be it Remembered
That on this 28th day of June in the Year of the Reign of Our Sovereign Lady VICTORIA, by the Grace of God, of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c., and in the Year of Our Lord One Thousand Eight Hundred and four personally appeared Isabella Muir of St John's in the Central District Widow, Robert Templeton of Saint John's Merchant and Robert C. Smith also of St John's Accountant and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal Sum of Four Thousand four hundred dollars to be had, made, and levied on their Goods, Chat-tels, and effects jointly and severally if default is made in any of the Conditions following:---

Now the Condition of this Obligation is such, that if the above bounden Isabella Muir as Administratrix cum testament annexo of the Estate and Effects of John McL Muir late of Bonne Bay Trader --------------- deceased, do make, or cause to be made, a just, true and perfect Inven-tory of all and singular, the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowl-edge of her the said Isabella Muir as such Administratrix ------------------------ or to the hands or possession of any other person or persons, for her and the same so made do exhibit, or cause to be exhibited, into the Su-preme Court of Newfoundland, at or before the 26th day of December next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come to the hands or possession of her the said Isabella Muir -------------------------or to the hands or possession of any other person or persons for her shall well and truly admin-ister according to Law, and further shall make, or cause to be made, a just and true account of her said Administration, on or before the 26th day of June which will be in the year of Our Lord One Thousand Eight Hundred and ninety five and afterwards from time to time as she shall be lawfully required. And all the rest, residue and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Admin-istration account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in a due course of Administration, or in such manner as the said Court shall direct;---then this Obligation to be void and of no effect or else to be and remain in full force and virtue.

          I Donald Morison of St John's Solicitor make oath and say as follows:-

(1). On the 30th day of May last I sent the following telegram to Simeon Avery one of the Executors nominated in the will of said John McL Muir deceased.
"Recommend Executors Muir renounce their Executorship
"and allow widow apply for administration with will annexed
"will see you and other executors secured for your commis-
"sion and disbursements consult other executors reply
"promptly"

(2). On the 31st day of May last I received the telegram hereto annexed marked "A" signed by the three persons nom-inated as Executors of will of said John McL Muir deceased.

Bonne Bay, To WIT:   }
I John E Roberts Richard Sheppard of Bonne Bay aforesaid Trader make oath and say that on the twenty fourth day of January A.D., One Thousand Eight Hundred and Ninety-four at Bonne Bay aforesaid I was present and did see John McL. Muir late of Bonne Bay Trader the Testator named in the paper writing hereunto annexed, duly sign, publish and declare the said annexed paper writing, as and for his last Will and Testament in my presence, and in the presence of John E Roberts and George W. Wilton &c, &c, both of Bonne Bay aforesaid the other subscribing witness thereto. That I and said John E. Roberts and George William Wilton then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other, and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.

In the Name of God Amen -

I John Mc La Muir of Bonne Bay District of St. Barbe colony of Newfoundland being weak in body but of sound mind and understanding do make this my last Will and Testament in manner and for no following that is to say
First    I give and bequeath my soul into the hands of God who gave it.
2          It is my will that my body be decently interred in the Church of England Cemetery of Bonne Bay and that my funeral be conducted without unnecessary astestation (?) and that the expenses Thereof together with all my just debts be fully paid.
3.         That my business be closed as soon after my death as is circumstances will permit in the following manner
First That all my stock of Goods Pocessions and general merchandize be sold by Auction or otherwise
Secondly To Compromise with any and all of my dealers whose names and accounts will be found in my Ledger Kept for that purpose. Also all those

all those whose names are in my Missed Book and collect all such debts as soon as circumstances will permit and that the same be forwarded wife I. McL Muir to my creditors as soon and as often as possible.
4th         I desire that my property in Rocky Harbor be sold for whatever it will realize the proceeds to be forward to my wife Isabella McL Muir now living in St. Johns
5th         I give and bequeath my Trunk and all it contains with my clothers, Bed Bedding and all my Books (except Masonic Book or Works) also to my wife Isabella McL Muir now living in St Johns
6th         I give all my Masonic works to Simeon Avery J.P. and John R. Roberts P.M. to be divided between them
7th         I give and bequeath my watch and chain to my Brother in Law Robert Templeton

 

The fifteenth line of Section Third of the Annex 'Will' should read.
          Forwarded to my wife Isabel McL Muir as soon and as often as possible.

And lastly I hereby constitute and appoint Simeon Avery J.P. John R. Roberts P.M. and Francis Cox to be executor's of this my last will and testament revoking and annulling all former wills by me made and certifying and confirm-ing this and no other to be my last will and testament

The Petition of Isabella Muir of Saint Johns Widow

Respectfully Sheweth as follows

  1. John McL Muir late of Bonne Bay Trader did there on the 24th day of January A.D. 1894 having previously made and executed his last will and testament which is hereto annexed and of which he appointed Simeon Avery; John R. Roberts and Frederick Cox all of Bonne Bay Executors.
  2. The said Executors have renounced their said Executorship.
  3. The said deceased at the time of his death was possessed of property of the probable value of two thousand two hundred dollars

Petitioner therefore prays that Administration of the said Estate of the said deceased with the said will annexed may be granted to him.

          Dated at St. John's this 22nd day of June A.D. 1894.

I do swear that I believe that John McL Muir late of Bonne Bay in the Southern District of the Island of Newfoundland Trader ------------------------------------------------------- deceased died with------- a Will, and that I will well and truly administer all and every the Goods of the said deceased, and pay his Debts so far as his Goods will extend; and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within Six months after the date hereof, or when I shall be thereunto lawfully required; and that the whole (of the goods,) rights, chattels, assets, credits and effects of the said deceased, of (which) he died possessed, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief amount to the value of Two thousand two hundred ---------- Dollars.
