In the Supreme Court of Newfoundland.

NEWFOUNDLAND, } I, Joseph Morris of Trinity in the
Trinity   To WIT:         } Northern District of Newfoundland Merchant -------------------------------- do swear that I believe this to be the true Last Will and Testament of James Morris late of Trinity aforesaid, Planter, deceased. I do further swear that I will pay all the Debts and Legacies of the said deceased so far as his Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said James Morris -----, deceased, and of which he died possessed, do not according to the best of my knowledge, judgment and belief, amount to the value of Four hundred and fifty dollars ---------------------------

So help me God.

This is the last will and testament of me James Morris, Senior of Trinity, Trinity Bay, in the Island of Newfoundland, Trader and Planter, being of Sound mind and in good health, thus publish and declare my last Will and Testament. --- Revoking and annulling all former dispositions of my property. - I give and bequeath to my Eldest Son Joseph Morris, All my land, fishing room, houses and tenaments, fields, gardens &c. - Situate in the Settlement of Tickle Cove.
I also give and bequeath unto my Son Joseph Morris, aforesaid all my houses, household furniture, and all utensils therein, or thereunto belonging together with all my interest in certain lands, houses stores, wharves and water privileges, connected there therewithin Situate in, or on, Harvey's Cove and Duck Lake, together with all my interest in certain Lands Situate near 'Hogs Nose", and also All my interest in the trade and business now existing and carried on under the "Firm & Tills" of James Morris & Sons, including, all Vessels, gear, fishing tackle craft &c.- with all my Estate 'real and personal" unto my Said eldest Son Joseph Morris - And I do hereby appoint my afforesaid son Joseph Morris as Sole Executor to this my last will and testament. - Dated this Eighteenth day of October A.D. One thousand Eight hundred and Eighty -------------

I Augustus Tibbs of Trinity in the Northern District Carpenter make oath and say that on the eighteenth day of October A. D. One Thousand Eight Hundred and ninety Eighty at Trinity aforesaid I was present and did see James Morris late of Trinity in the Northern District, Trader and Planter the Testator named in the paper writing hereunto annexed, marked A, duly sign, (by making his mark) publish and declare the said annexed paper writing, as and for his last Will and Testament in my presence and in the presence of Gilbert Humphrey Cole, squire, Stipendiary Magistrate at Trinity aforesaid the other subscribing witness thereto. That I and said Gilbert Humphrey Cole then and there signed our names to such Will as such witnesses, in presence of the said Testator and of each other. That previously to the said Will being so sign-ed, as aforesaid, by the said Testator and the said witnesses, it was read over to, and approved of by, the said Testator in the presence of me and the said Gilbert Humphrey Cole and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of my know-ledge and belief.

          The Petition of Joseph Morris of Trinity in the Northern District Merchant

Humbly Sheweth

                    That
Your Petitioner's father James Morris late of Trinity in the Northern District Planter died on the fourteenth day of January now last past having first made and published his last will and testament which is hereto annexed, marked "A"
                    That
Your Petitioner is sole executor of the said will and sole legatee under it.
                    That
the said James Morris left him surviving as next of kin three sons, Your Petitioner, Joseph Jacob Morris of St. John's Carpenter and Henry Morris of St. John's Mariner and three daughters Louisa Wiseman wife of Mark Wiseman of Tickle Cove near Trinity, Marian Crocker wife of Patrick Crocker of Trinity, mariner and Mary Jane Adams wife of William Adams of St. John's Carpenter.
                    That
the said James Morris at the time of his death was possessed of property within the Jurisdicition of the Honourable Court which did not amount in value to four hundred dollars.
                    That
No probate of any will or letters of administration in the estate of the said James Morris have
been

been granted. Petitioner therefore
Your Petitioner therefore prays that Probate of the will of the said James Morris may be granted to your Petitioner, the executor therein named.
And as in duty bound Your Petitioner will ever pray &c.
