AFFIDAVIT.

In the Supreme Court of Newfoundland.

NEWFOUNDLAND, }
St. John's    To WIT:    } I, Patrick Kennedy, Junior, of St. John's, Clothier -------------- do swear that I believe this to be the Last Will and Testament of Roger McGrath late of St. John's, in the Central District, Gentleman deceased. I -------------------------------- do further swear that I will pay all the Debts and Legacies of the said deceased so far as his Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Roger McGrath, deceased, and of which he died possessed, do not, according to the best of my knowledge, judgment and belief, amount to the value of Seven Thousand dollars

So help me God.

After three days from the date hereof application will be made to the honorable the Supreme Court or any one of the honorable the Judges thereof that probate of the will of the late Roger McGrath of St Johns deceased do issue forthof the Supreme Court to Patrick Kennedy Jr. also of St Johns Clothier the executor in the said will named

I, Roger M Grath, of St John's, being in my senses now make, declare and affirm this to be my Last Will & Testament. I appoint Patrick Kennedy Junior as Executor.
1st          I give, devise and bequeath to my son Revd J.J. M Grath of Villa Nova, all my Property as follows
Freehold: of Wooden Tenement Dwelling's situate on Lemarchant Rd, St Johns
Leased Property: 1 Double Tenement House on Hamilton Street, on the corner of Morris' St. on ground belonging to estate late Jas Harvey.
1 Wooden House with Shop situate on Hamilton St on ground belonging to estate late Dr. Sullivan.
Finally, all the residue of my estate in Money in the Savings Bank.
3rd I appoint and make the said Revd J.J. M Grath sole heir of my estate, and the same will collect all amounts due and pay all lawful bills due by the Testator.
We declare the above to be the last will         } Roger McGrath
& Testament of the signed and made              }
in his and our presence and in the presence   }

I Patrick Kennedy of St John's, aforesaid, Tailor make oath and say that on the Fifth day of December A.D., One Thousand Eight Hundred and Ninety-three at St Johns aforesaid I was present and did see Roger McGrath late of St John's Gentleman ---- the Testator named in the paper writing hereunto annexed marked A, duly sign, publish and declare the said annexed paper writing, as, and for his last Will and Testament in my presence, and in the presence of John Carroll ---------------------------- the other subscribing witness thereto. That I and said John Carroll then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding to the best of my knowledge and belief.

The petition of Patrick Kennedy, junior of St Johns Clothier

Humbly Sheweth

1 That Roger McGrath late of St Johns Gentleman died there on or about the 8th day of October Anno Domino 1893 having first duly made and executed his last will and testament and which is hereto annexed marked A and so proved in common form
2 That the said Roger McGrath died possessed of property within the jurisdiction of this honorable Court to the probable value of about $700000
3 That the said Testator left him surviving his widow Ellen McGrath and an only son the Reverend James J. McGrath of Villa Nova Topsail
4 That in and by his said last Will and Testament the said Testator appointed your petitioner to be executor thereof
Petitioner therefore prays that probate of the said will be granted to him forth of this honorable Court And as in duty bound he will ever pray &c &c &c
