AFFIDAVIT.

In the Supreme Court of Newfoundland.
--------------

NEWFOUNDLAND, } I, Patrick Duggan at
St. John's     To Wit:    } present of St John's in the Central District Fireman do swear that I believe that Bridget McCarthy late of Spaniards Bay in the Northern District, Widow ----------deceased died with-------- a Will; and that I will well and truly administer all and every the Goods of the said deceased, and pay her Debts so far as her Goods will extend and the law shall bind me and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court,within Six months after the date hereof, or when I shall be thereunto lawfully required; and that the whole of the goods, rights chattels, assets, credits and effects of the said deceased, of which she died possessed, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of Eight hundred and fifty Dollars.

So help me GOD.

I Bridget McCarthy widow of the late Thomas McCarthy of Spaniards Bay Beach calling to derive the uncertainty of life and certainty of death, do make and appoint this my last will and testament, in manner following viz? I give and bequeath to my nephew Patrick Duggan who now resides with me all and singular the dwelling house, out houses, Hobbs?, farm, gardens, farm utensils, cattle, poultry, household furniture and any thing else of which I am now possessed to have and to hold the land? For use after my death. In witness whereof I have hereunto affixed my mark in presence of Witnesses

I James Daley of Bay Roberts in the Northern District make oath and say that on the Twenty-first day of April A.D. One Thousand Eight Hundred and ninety Seventy Seven at Spaniards Bay, I was present and did see Bridget McCarthy late of Spaniards Bay ---------------------- the Testatrix named in the paper writing hereunto annexed, marked A, duly sign, (by making her mark) publish and declare the said annexed paper writing, as and for her last Will and Testament in my presence and in the presence of John O'Keefe -------------------------------------------- the other subscribing witness thereto. That I and said John O'Keefe then and there signed our names to such Will as such witnesses, in presence of the said Testatrix and of each other. That previously to the said Will being so signed, as aforesaid, by the said Testatrix and the said witnesses, it was read over to, and approved of by, the said Testatrix in the presence of me and the said John O'Keefe and that at the time of the said execution of the said Will the said Testatrix was of sound and disposing mind, memory and understanding, to the best of my know-ledge and belief.

Notice

Three days from this date application will be made to the Honorable the Supreme Court or one of the Honorable the Judges Thereof for Letters of Administration C.T.A. to the Estate of the late Bridget McCarthy late of Spaniards Bay Beach in the Northern District Widow deceased to be granted to Patrick Duggan at present of St. Johns and Nephew of said deceased.

of Newfoundland or one of
the Honorable the Judges thereof

          The Petition of Patrick Duggan at present of St. John's in Newfoundland aforesaid Fireman

Humbly Sheweth as follows

          That Bridget McCarthy widow of the late Thomas McCarthy deceased died at that place Spaniards Bay Beach in Conception Bay Newfoundland on the 4th day of December AD 1887.

          That previous to her death the said deceased made and Executed her last Will & Testament which is hereunto annexed proven upon the affidavit of James Daley of Bay Roberts in Conception Bay aforesaid one of the Subscribing Witnesses thereto.

          That the said deceased neglected to appoint an Executor to her said last Will & Testament.

          That in and by said last Will and Testament your petitioner was named and appointed sole LEgater

          That at the time of her death the said deceased was possessed of property within the Jurisdiction

of this Honourable Court of the value of about Eight hundred dollars

          That neither Probate to any last Will or Administration to the Estate of said deceased has yet been granted to any person.

          Your Petitioner therefore prays that Your Honorable Court will grant him Administration Cum testament annexo to said Estate and as in duty bound will ever pray &c &c &c

                    Be it Remembered,
That on this 28th day of November in the 58th Year of the Reign of Our Sovereign Lady VICTORIA, by the Grace of GOD, of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c., and in the Year of Our Lord One Thousand Eight Hundred and ninety four personally appeared Patrick Duggan of St. John's in the Central District Fireman Daniel Costello of Salmon Cove Conception Bay, Planter and James Lewis of Conception Harbor, Planter ------------------ and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal sum of Seventeen hundred dollars ---------- to be had, made, and levied on their Goods, Chat-tels, and effects jointly and severally if default is made in any of the Conditions following:---

                    Now the Condition of this Obligation is such, that if the above bounden Patrick Duggan ----- as Administrator with the will annexed of the Estate and Effects of Bridget McCarthy late of Spaniards Bay, Northern District, widow deceased, do make, or cause to be made, a just, true and perfect Inven-tory of all and singular, the Goods, Credits and Effects of the said deceased, which have or shall come to the hands possession, or knowl-edge of him the said Patrick Duggan as such Administrator ------------------------------- or to the hands or possession of any other person or persons, for him and the same so made do exhibit, or cause to be exhibited into the Su-preme Court of Newfoundland, at or before the 28th day of May next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of her death or which at any time afterwards shall come to the hands or possession of him the said Administrator ------------------------ or to the hands or possession of any other person or persons for him shall well and truly admin-ister according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the 28th day of November which will be in the year of Our Lord One Thousand Eight Hundred and ninety five and afterwards from time to time as he shall be lawfully required. And all the rest, residue and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Admin-istration account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in a due course of Administration, or in such manner as the said Court shall direct;---then this Obligation to be void and of no effect or else to be and remain in full force and virtue.
