AFFIDAVIT.

In the Supreme Court of Newfoundland.

NEWFOUNDLAND, } I, Alexander J.W. McNeily of
St. John's To Wit:        } St. John's in the Central District Chief Clerk & Registrar of the Supreme Court do swear that I believe that Isaac Kendall, late of Grand Bank in the Southern District of Newfoundland, Lobster packer ------------------------------- deceased died without a Will; and that I will well and truly administercollect, receive and hold custody all and every the Goods of the said deceased and pay his Debts so far as his Goods will extend; and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of the AdministrationCollection into the Registry of the said Court, within Six months after the date hereof, or when I shall be thereunto lawfully required; and that the whole of the goods, rights, chattels, assets, credits and effects of the said 'deceased, of which he died possessed, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of one thousand dollars -------------Dollars.

To the Honourable the Supreme Court or to one of the Honourable the Judges thereof

The Petition of George ----- Knowling of St. John's Merchant

Respectfully Sheweth as follows:

  1. Isaac Kendall late of Grand Bank Lobster Packer died there about three weeks ago intestate leaving as next of Kin an uncle residing in New-foundland and one brother residing in Canada.

  2. The said deceased at the time of his death was possessed of property consisting principally of Lobster factory and stock-in-trade of the probable value of nine hundred and fifty dollars. The said property since the death of said Isaac Kendall has been taken charge of temporarily by a man residing in the vicinity and it is necessary in the interests of said estate that an ad-ministrator thereof should be ---- appointed without delay.

  3. The said deceased at the time of his death was indebted to Petitioner in the sum of Six hundred and forty four dollars and Seventy three cents.

Petitioner

          Petitioner therefore prays that administration of the estate of deceased may be granted to one of the Clerks of this Honourable Court or to such other person as may be appointed
